ORDINANCE NO. 990581

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0189, rezoning an area of approximately 17.14 acres generally located south of a line about 700 feet north of proposed N.W. 101st Terrace, north of proposed N.W. 101st Terrace, west of N.W. Skyview Avenue and east of N. Executive Hills Boulevard, from Districts GP-1 (General Industry) and GP-3 (Regional Business) to District GP-4 (High Density Residential Uses), and approving a development plan for the same. (6091-GP-13)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0189, rezoning an area of approximately 17.14 acres generally located south of a line about 700 feet north of proposed N.W. 101st Terrace, north of proposed N.W. 101st Terrace, west of N.W. Skyview Avenue and east of N. Executive Hills Boulevard, from Districts GP-1 (General Industry) and GP-3 (Regional Business) to District GP-4 (High Density Residential Uses), said section to read as follows:

 

Section 80-11A0189. That an area legally described as:

 

Parcel 9, Parcel 10 and part of Parcel 6, Tiffany Centro, a subdivision of land in the Northeast 1/4 of Section 36, Township 52 North, Range 34 West of the 5th Principal Meridian, Kansas City, Platte County, Missouri, being bounded and more particularly described as follows: Beginning at the northeast corner of the South 1/2 of said Northeast 1/4, also being the northeast corner of said Parcel 10; thence South 042'33" West (all bearings herein are referenced to the Missouri State Plane Coordinate System, 1983 West Zone) on the east line of said Northeast Quarter and the east line of said Parcel 10, 666.92 feet to the centerline of N.W. 101st Street Terrace; thence North 8956'00" West on said centerline, 29.28 feet to a point of curvature; thence westerly on a curve to the left on said centerline (said curve having a radius of 2200.00 feet, chord bearing South 8514'29" West, chord distance of 370.12 feet) an arc length of 370.55 feet to a point of tangency; thence South 8024'58" West on said centerline, 231.18 feet to a point of curvature; thence westerly on a curve to the right on said centerline (said curve having a radius of 1200.00 feet, chord bearing North 8654'25" West, chord distance of 526.69 feet) an arc length of 531.01 feet to a point on the southerly prolongation of a line 470.00 feet east from, as measured perpendicular to, the west line of said Parcel 6; thence North 1735'42" East on said line and its prolongation, 743.86 feet to the north line of said Parcel 6 and the north line of the South 1/2 of said Northeast 1/4; thence South 8954'42" East on said north line, 935.40 feet to the point of beginning.

 

is hereby rezoned from Districts GP-1 (General Industry) and GP-3 (Regional Business) to District GP-4 (High Density Residential Uses), all as shown outlined on a map marked Section 80-11A0189, which is attached hereto and made a part hereof, and which is hereby adopted as a part of


an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer dedicate additional right of way for N.W. 101st Terrace as required by the Department of Public Works so as to provide 50 feet of right of way as measured from the centerline of N.W. 101st Terrace.

 

5. That the developer improve one-half of N.W. 101st Terrace to primary arterial street standards as required by the Department of Public Works, including construction of curb, gutter and sidewalks and installation of streetlights.

 

6. That the developer dedicate right of way for the north/south street along the entire west boundary of the development plan as required by the Department of Public Works so as to provide 60 feet of right of way for the north/south street.

 

7. That the developer improve the north/south street along the entire west boundary of the development plan to collector street standards as required by the Department of Public Works.

 

8. That the developer extend water mains as required by the Water Services Department.

 

9. That the developer extend sanitary sewers as required by the Department of Public Works.

 

10. That the developer comply with the Kansas City International Airport Height Zoning Restrictions and that such restrictions be included on the final plat.

 

11. That the developer grant an Aviation Noise Easement (for each phase) to the City and file the same with each final plat as required by the Aviation Department.

 

12. That the developer submit a Fair Disclosure Agreement as required by the Aviation Department.

 

13. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

14. That the developer construct a temporary cul-de-sac at the east end of N.W. 101st Terrace as required by the Department of Public Works.

 

15. That the developer contribute $27,811.51 in lieu of parkland dedication for 216 multi-family units (216 x 2 x 0.006 x $10,729.75) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

16. That the developer secure the approval of the Street Naming Committee for all street names.

 

17. That the developer provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

18 That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, grading and screening, prior to the issuance of a building permit.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 990581, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
