ORDINANCE NO. 060433

 

Amending Ordinance No. 060159, adopted February 23, 2006 to add Tract 88A for condemning and taking permanent and temporary easements on private properties for the improvement and maintenance of NW Barry Road, from N. Conant Avenue to N. Congress Avenue, all in Kansas City, Platte County, Missouri.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Ordinance No. 060159, is hereby amended by adding Tract 88A, condemning and taking in fee simple permanent right of way, and temporary easement, to read as follows:

TRACT 88A General Warranty Deed (Fee Simple Interest)

A portion of the Southwest Quarter of the Northwest Quarter of Section 12, Township 51 North, Range 34 West in Kansas City, Platte County, Missouri, being more particularly described as follows:

 

Beginning at the intersection of the East line of said Quarter, Quarter Section with the North right of way line of Northwest Barry Road, as now established 40 feet North of the South line of said Quarter, Quarter Section, as measured perpendicular to the South line thereof; thence North 89 degrees 50 minutes 15 seconds West along said Northerly right-of-way line, being along a line 40 feet North of and parallel with the Southerly line of said Quarter, Quarter, Section, a distance of 30.00 feet; thence North 00 degrees 02 minutes 59 seconds East, no longer along said Northerly right-of-way line, a distance of 16.19 feet; thence South 89 degrees 50 minutes 23 seconds East, 30.00 feet to a point on the Easterly line of said Quarter, Quarter Section, being also a point on the Westerly line Lot 1, WILDBERRY, a subdivision in Kansas City, Platte County, Missouri, according to the recorded plat thereof; thence South 00 degrees 02 minutes 59 seconds West, along the Easterly line of said Quarter, Quarter Section, being also along the Westerly line of said Lot 1 and its Southerly extension, a distance of 16.19 feet to the Point of Beginning. Containing 485 square feet, more or less.

TRACT 88A Temporary Easement

A portion of the Southwest Quarter of the Northwest Quarter of Section 12, Township 51 North, Range 34 West in Kansas City, Platte County, Missouri, being more particularly described as follows:

 

Beginning at the intersection of the East line of said Quarter, Quarter Section with the North right of way line of Northwest Barry Road, as now established 40 feet North of the South line of said Quarter, Quarter Section, as measured perpendicular to the South line thereof; thence North 00 degrees 02 minutes 59 seconds E, a distance of 16.19 feet to the True Point of Beginning; thence North 89 degrees 50 minutes 15 seconds West along said Northerly right-of-way line, being along a line 40 feet North of and parallel with the Southerly line of said Quarter, Quarter, Section, a distance of 30.00 feet; thence North 00 degrees 02 minutes 59 seconds East, no longer along said Northerly right-of-way line, a distance of 34.00 feet; thence South 89 degrees 50 minutes 23 seconds East, 30.00 feet; to a point on the Easterly line of said Quarter, Quarter Section, being also a point on the Westerly line Lot 1, WILDBERRY, a subdivision in Kansas City, Platte County, Missouri, according to the recorded plat thereof; thence South 00 degrees 02 minutes 59 seconds West, along the Easterly line of said Quarter, Quarter Section, being also along the Westerly line of said Lot 1 and its Southerly extension, a distance of 34.00 feet to the Point of Beginning. Containing a net area of 1020 square feet, more or less.

 

Section 2. That all other sections contained in Ordinance No. 060159 shall remain in full force and effect unless otherwise specifically amended herein.
