Approving an amendment to a previously approved development plan in District URD on approximately a 217.62 acre tract of land generally bounded by Front Street on the south, Universal Avenue and Reynolds Avenue on the west, the Missouri River on the north and I-435 on the east. (10333-URD-4)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District URD (Urban Redevelopment District) on approximately a 217.62 acre tract of land generally bounded by Front Street on the south, Universal Avenue and Reynolds Avenue on the west, the Missouri River on the north and I-435 on the east, and more specifically described as follows:

Containing 9,479,440.64 square feet or 217.62 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit an update to the previously accepted macro storm drainage study for the overall development to address the development amendments along with a detailed micro storm drainage study for review and acceptance prior to clearance of the final plat and make necessary improvements as required by Development Services.

3. That the developer enter into a deferral agreement by January 30, 2007, for the construction of the Alternative 1C improvements, as presented in the Universal Avenue Stormwater Study, August 2006, by Bucher Willis & Ratliff, commissioned by the Water Services Department, as required by Water Services Department. If the developer does not enter into the deferral agreement by January 30, 2007, no further plats will be approved until the agreement is entered into. The deferral agreement will substantially contain the terms reflected in Exhibit A, attached hereto.

 

4. That the developer submit plans for grading and siltation and erosion control to Development Services for approval prior to beginning any construction activities.

 

5. That the developer extend water mains as required by the Water Services Department.

 

6. That the developer provide for fire protection as required by the Fire Department.

 

7. That the developer secure the approval of the Street Naming Committee for all street names.

 

8. That the developer obtain a floodplain certificate if any grading is to occur within a floodplain.

 

9. That the developer secure a land disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre.

 

10. That the developer secure the approval of the Missouri Department of Transportation prior to working in any State right of way.

 

11. That the developer provide cross-access easements on the final plat as required by Development Services.

 

12. That the developer record all plats within the Executive Park area in sequential order.

 

13. That the developer submit a site plan to the Director of City Development for approval including landscaping, berming and architectural features, streetscaping, lighting, including a photometric study showing zero footcandles at the property line and signage. The landscaping plan shall identify adequate area for planting of trees and shrubs within the parking lots.

 

14. That the developer dedicate additional right of way prior to the approval of the Sixtieth Final Plat for improvements as required by Development Services so as to provide the minimum right of way required for the proposed City/MoDOT improvements along Front Street as shown on the recently approved Missouri Department of Transportation Roadway Improvement plans for the Front Street/I-435 improvement project.

 

15. That the developer dedicate additional right of way for a collector street as required by Development Services so as to provide a total of 60 feet of right of way for N. Cambridge Avenue as shown on the approved development plan.

16. That the developer show a reserve for future additional right of way for a collector street as required by the Department of Public Works so as to provide a total of 60 feet of right of way for N. Commerce Avenue as shown on the approved development plan, on an alignment extending straight east from existing Commerce Avenue.

 

17. That the developer secure permits to construct sidewalks in accordance with the approved walkability plan, as required by Development Services, prior to recording the plat.

 

18. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

19. That the developer shall subordinate to the City all private interest in the area of any right-of-way dedication as required by Development Services, and that the developer shall be responsible for all costs associated with subordination activities.

 

20. That the developer extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by Development Services.

 

21. That the developer show the limits of the 100-year floodplain on the final plat.

 

22. That the developer show the lowest opening or elevation or Minimum Low Opening (MLO) of any structure on each lot that abuts a 100-year floodplain area on the final plat.

 

23. That the developer submit covenants, conditions and restrictions to Development Services for review by the Law Department for approval for the maintenance of private open space and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
