COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 030828

 

Approving a Community Unit Project on an approximately 10 acre tract of land generally located 1100 feet south of N.W. Barry Road on the west side of Platte Purchase Drive. (9569-CUP-8)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 10 acre tract of land generally located 1100 feet south of N.W. Barry Road on the west side of Platte Purchase Drive, and more specifically described as follows:

 

All that part of the Fractional Southwest Quarter of Section 10, Township 51, Range 33, Kansas City, Platte County, Missouri, being described as follows: Commencing at the southwest corner of said Fractional Southwest Quarter; thence North 0E3244 East (Deed - North 0E3004 East), along the west line of said Fractional Southwest Quarter, 1124.99 feet to the true point of beginning of the tract to be herein described; thence continuing North 0E3244 East, along said west line, 605.43 feet to the southwest corner of Lot 1, Barry Woods Station, a subdivision of land in Kansas City, Platte County, Missouri; thence North 89E0621 East (Plat - North 89E0626 East), along the south line of said Lot 1, 623.29 feet (Plat - 623.47 feet) to a point on the westerly right-of-way line of N. Platte Purchase Drive, as now established; thence South 15E1312 East (Deed - South 15E1552 East), along said westerly right-of-way line, 384.28 feet; thence southerly along said westerly right-of-way line, on a curve to the right, tangent to the last described course, having a radius of 1115.92 feet, a central angle of 13E2220, an arc distance of 260.44 feet; thence North 89E0326 West, 768.53 feet to the true point of beginning. Containing 10.01 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit an overall storm drainage study to the City Engineers Office for approval at the time the first final plat is submitted, with detailed storm drainage studies to be submitted for each phase of development at the time of final platting, and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 


4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer submit a street name signage plan to the Street Naming Committee for approval.

7. That the developer obtain the grading consents, and all grading, temporary construction and drainage easements from the abutting property owner prior to submitting any public improvements.

 

8. That the developer dedicate additional right of way for N. Platte Purchase Drive as required by the Department of Public Works so as to provide a total of 46 feet of right of way as measured from the centerline of N. Platte Purchase Drive.

 

9. That the developer provide adequate sight distance for N. Platte Purchase Drive at both proposed subdivision entrances as required by the Department of Public Works.

 

10. That any relocated streetlights be integrated into the existing street lighting system as required by the Department of Public Works.

 

11. That the developer construct all internal streets to residential street standards with a total right of way of 50 feet as required by the Department of Public Works, including construction of curbs, gutters and sidewalks and installation of streetlights.

 

12. That the developer contribute $17,653.03 in lieu of parkland dedication for 70 single family units (70 x 3.7 x 0.006 x $11,389.05) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

13. That the developer extend water mains and provide easements as required by the Water Services Department.

 

14. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

15. That the developer extend sanitary and/or storm sewers to ensure individual service is provided to all proposed units and determine adequacy as required by the Department of Public Works.

 

16. That the developer submit a Certificate of Survey to the Department of City Development for approval prior to the sale of individual units.

17. That the developer submit covenants, conditions and restrictions to the Law Department for approval.

 

18. That the developer submit a street tree planting plan as part of the final plat and secure the approval of the City Forester for street trees planted on right of way in front of residential lots. A copy of the street tree planting plan shall be submitted to the Department of City Development. The plan shall include size, type, species and placement of trees.

 

19. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on grading, landscaping, signage (including elevations) and building elevations.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 030828, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
