ORDINANCE NO. 990724

 

Approving an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on approximately a 4 acre tract of land generally located at the northwest corner of N. Antioch Road and I-35. (7201-CP-7)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on approximately a 4 acre tract of land generally located at the northwest corner of N. Antioch Road and I-35, and more specifically described as follows:

 

TRACT I: All of Lot 1, Brookwood Extension, together with the south one half of N.E. 44th Street lying north of and adjacent to said Lot 1, Brookwood Extension, as vacated by the City Council of Kansas City, Missouri, in Ordinance No. 37329, a certified copy of which was filed in the office of the Recorder of Deeds of Clay County on August 26, 1970 as Document No. C47094, except that part conveyed to the State of Missouri for Highway Interstate No. 35 and except that part lying in Route 1 or Antioch Road on the east, all in Kansas City, Clay County, Missouri.

 

TRACT II: West 88 feet of Lots 1, 2 and 3, Brookwood Heights, an addition in the City of Kansas City, Clay County, Missouri, and the west 88 feet of the north one half of that portion of vacated 44th Street north lying between Antioch Road and the southerly prolongation of the west line of Lot 1, Brookwood Heights, an addition in Kansas City, Clay County, Missouri, except north 5 feet conveyed to Kansas City by deed filed of record September 29, 1976 as Document No. D34466.

 

is hereby approved, subject to the following conditions:

 

1. That the developer submit a storm drainage study to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 

2. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

3. That the developer provide for fire protection as required by the Fire Department.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer secure the approval of the Missouri Department of Transportation prior to working in any State right of way.

 


6. That the developer secure the approval of the Board of Zoning Adjustment for variances to the required number of parking spaces, to the required paving setback along 44th Terrace and to allow a sign on an ornamental tower that identifies an individual tenant instead of the commercial center.

 

7. That the developer grant a cross-access easement to allow access from this development to the undeveloped parcel to the west prior to the approval of the final plan.

 

8. That the developer enter into a deferral agreement with the City as required by the Department of Public Works prior to the approval of a final plan whereby the developer agrees to improve the southern half of N.E. 44th Terrace to residential street standards, including construction of curb, gutter and sidewalks and installation of streetlights, at such time as N.E. 44th Terrace is improved to the east.

 

9. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, grading, screening, berming and signage.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 990724, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
