ORDINANCE NO. 050201

 

Approving an amendment to a previously approved preliminary plan in District C-2-p (local retail business, limited district) on approximately a 14.9 acres tract of land generally located on the south side of 104th Street east of State Line Road (7825-P-15)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District C-2-p (Local Retail Business Limited District) on approximately a 14.9 acre tract of land generally located on the south side of 104th Street east of State Line Road, and more specifically described as follows:

 

Lots 1 through 4 inclusive, Superior Auto Park, a subdivision in Kansas City, Jackson County, Missouri

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, commonly know as the Subdivision Regulations.

 

2. That the developer submit a new, or update the previously approved macro storm drainage study for the overall development to the City Engineers Office to address the plan amendments, with a micro detailed storm drainage study to be submitted at the time of final platting, and that the developer construct any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

4. That the developer obtain the grading consents and all grading, temporary construction and drainage/sewer easements from abutting property owners prior to submitting any public improvements.

 

5. That the developer submit a detailed micro storm drainage study, consisting at a minimum of a letter from a Missouri licensed civil engineer stating that the proposed improvements will not alter or increase historical runoff conditions for the site, to the City Engineers Office prior to approval and issuance of any building permits, and that the developer make any improvements as required by the City Engineers Office.

 

6. That the developer secure a site disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

7. That the developer obtain a floodplain certificate from the Department of Codes Administration prior to beginning any construction activities within the floodplain.

 

8. That the final plat show the 100-year floodplain and the lowest opening or elevation or Minimum Low Opening (MLO) of any structure on each lot that abuts a 100-year flood prone area.

 

9. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping, signage (including elevations), lighting (including a photometric sturdy showing zero footcandles at the plan boundary and no direct illumination beyond the plan boundary)and building elevations.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
