ORDINANCE NO. 001648
Approving
an amendment expanding the Downtown Paseo West Area General Development Plan
and Declaration of Blight by declaring the area generally located one-half
block west of Paseo between E. 9th Street and E. 14th Street, a blighted and
insanitary area in need of redevelopment and rehabilitation; approving the
general development plan for the same, said plan to be known as the Amended
Downtown Paseo West Area General Development Plan; and approving ad valorem tax
benefits for the area.
WHEREAS,
Section 100.400, RSMo, 1986, as amended, provides that a legislative body may
approve a declaration of blight and approve a General Development Plan for the
same area simultaneously; and
WHEREAS,
the City Council did on August 21, 1980, adopt Ordinance No. 51878 declaring
that the Downtown Paseo West Area is blighted, insanitary or undeveloped,
pursuant to Section 100.400, RSMo, and the City Council did on November 13,
1980, adopt Ordinance No. 52079 approving the Downtown Paseo West Area General
Development Plan for the area; and
WHEREAS,
the Planned Industrial Expansion Authority of Kansas City, Missouri, has
submitted a General Development Plan for an expanded Downtown Paseo West Area
generally located one-half block west of Paseo between E. 9th Street and E.
14th Street ("Expanded Area"); and
WHEREAS,
said area is blighted due to insanitary or unsafe conditions, deterioration of
site improvements, and a combination of such factors as to constitute an
economic or social liability to the public health, safety, morals and welfare;
and
WHEREAS,
the Planned Industrial Expansion Authority of Kansas City, Missouri, did on
April 26, 2000, adopt Resolution No. 568, approving the Amended Downtown Paseo
West Area Factual Evidence of Blight, and Resolution No. 567, approving the
Amended Downtown Paseo West Area General Development Plan; NOW, THEREFORE,
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
1. That the proposed Planned Industrial Expansion Area identified as the
Expansion Area, generally located one-half block west of Paseo between E. 9th
Street and E. 14th Street, is a blighted area and in need of redevelopment and
rehabilitation and is appropriate for a Planned Industrial Expansion Area
project, and that the undertaking by the Planned Industrial Expansion Authority
of Kansas City, Missouri, of surveys and plans for a Planned Industrial
Expansion Area project of the character contemplated by Section 100.300, et
seq., Revised Statutes of Missouri, 1986, as amended, ("RSMo"), in
the proposed Planned Industrial Expansion Area is hereby approved.
Section
2. That the amended General Development Plan for the Downtown Paseo West Area
as described above, is hereby approved. A copy of said plan is attached hereto
and incorporated herein by reference as Document No. 001648, on file in the
office of the City Clerk.
Section
3. That the Council has duly made the findings necessary for compliance with
Section 100.400, RSMo.
Section
4. That said Amended General Development Plan is hereby found to be feasible
and in conformance with the General Plan for the development of the community
as a whole.
Section
5. That the Council hereby grants ad valorem tax benefits to the Downtown
Paseo West Area pursuant to Section 100.570, RSMo. Specifically, the real
property ascribed therein shall not be subject to ad valorem taxes imposed for
a period of ten (10) years except to such extent and such amount as may be
imposed upon such real property measured solely by the amount of the assessed
valuation of the land, exclusive of improvements, and further for the next
following period of fifteen (15) years, ad valorem taxes upon such real
property shall be measured by the assessed valuation of fifty percent (50%) of
the value of such real property including improvements.
Section
6. That the Council finds and declares that before taking any action on the
proposed declaration of blight, General Development Plan and ad valorem tax
benefits, all public notices have been given and hearings have been held as
required by law.
