ORDINANCE NO. 020453

 

Approving an amendment to a previously approved Community Unit Project plan in District R-2b (Two-Family Dwellings) on approximately a 23.15 acre tract of land generally located on the west side of U.S. Highway 350 approximately one-quarter mile north of Bannister Road. (9619-CUP-3)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved Community Unit Project plan in District R-2b (Two-Family Dwellings) on approximately a 23.15 acre tract of land generally located on the west side of U.S. Highway 350 approximately one-quarter mile north of Bannister Road, and more specifically described as follows:

 

A tract of land in the Northeast Quarter of the Southeast Quarter and in the Southeast Quarter of the Northeast Quarter, all in Section 26, Township 48, Range 32, in Kansas City, Jackson County, Missouri, described as follows: Commencing at the southeast corner of the Southeast Quarter of said Section 26-48-32; thence North 03E26'41" East along the east line of said Quarter Section, a distance of 1942.16 feet; thence North 85E55'23" West, a distance of 206.69 feet to the point of beginning, said point being 70 feet right of P.T. Station 23+30.20 of U.S. Highway No. 350 outer road; thence North 82E17'21" West, a distance of 633.20 feet; thence North 34E32'00" West, a distance of 835.61 feet to the southwest corner of the Southeast Quarter of the Northeast Quarter of said Section 26-48-32; thence North 03E10'26" East along the west line of said Quarter Quarter Section, a distance of 789.91 feet to a point on the southerly right of way of U.S. Highway No. 350; thence South 57E36'34" East parallel with the survey centerline of said Highway, a distance of 61.15 feet to a point 290 feet opposite centerline Station 472+16.5 (350 Highway), said point being 90 feet right of centerline Station 8+07.30 (outer road); thence continuing along said Highway right of way South 61E26'41" East, a distance of 257.92 feet to a point 260 feet right of centerline Station 475+00 (350 Highway); thence continuing along said Highway right of way in a southeasterly direction along a curve to the right, having an initial tangent bearing of South 51E56'22" East, a radius of 2,604.79 feet, a central angle of 18E43'12", an arc length of 851.05 feet to a point 260 feet right of centerline Station 484+36 (350 Highway), said point also being 81 feet right of centerline Station 19+40.20 (outer road); thence continuing along said Highway right of way, South 32E41'55", a distance of 242.41 feet to a point 70 feet right of centerline Station 22+00 (outer road); thence continuing along said Highway right of way in a southwesterly direction along a curve to the right, having an initial tangent bearing of South 23E37'10" East, a radius of 1,075.92 feet, a central angle of 31E30'37", an arc length of 591.71 feet to the point of beginning, containing 23.15 acres.

 

is hereby approved, subject to the following conditions:

 


1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural resources.

 

6. That the developer extend water mains and grant easements as required by the Water Services Department.

 

7. That the developer extend sanitary sewers as required by the Department of Public Works.

 

8. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

9. That the developer secure the approval of the Missouri Department of Transportation prior to working within any State right of way.

 

10. That, prior to the issuance of any certificates of occupancy for any buildings within the Community Unit Project plan, a left turn lane with taper on southbound Pryor Road at Bannister Road be constructed, that left turn lanes with tapers be constructed on Pryor Road at each driveway entrance and that Pryor Road between those improvements be widened to a minimum of 32 feet in paved width.

 

11. That the developer secure a subordination agreement from all utilities crossed by proposed public utilities as required by the Department of Public Works.

 

12. That the developer receive the approval of the Board of Zoning Adjustment for a variance to the maximum allowed height and approval for any residential identification signage.

 

13. That the developer contribute $49,369.88 in lieu of parkland dedication for 320 units (320 x 2.0 x .006 x $12,856.74) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

14 That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping (including canopy shade trees a maximum of 50 feet on center along the Pryor Road frontage and the western boundary with the Wedgewood Point development, and upright evergreens a maximum of 20 feet on center along the west side of the elderly apartment access drive where it encroaches into the 150 foot buffer), signage (including elevations), lighting (including luminaire design to screen direct light from adjacent properties) and building elevations.

 

A copy of said amended Community Unit Project plan is on file in the office of the City Clerk under Document No. 020453, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
