ORDINANCE NO. 961107

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2674, rezoning an area of approximately 2.8 acres generally located on the east side of Troost Avenue, between 49th Street and 51st Street, from District R-4 (Low Apartments) to District URD (Urban Redevelopment District), and approving a development plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2674, rezoning an area of approximately 2.8 acres generally located on the east side of Troost Avenue, between 49th Street and 51st Street, from District R-4 (Low Apartments) to District URD (Urban Redevelopment District), said section to read as follows:

 

Section 65.010A2674. That an area legally described as:

 

All of Lots 5 through 28, inclusive, together with that part of Lot 4 and Lot 29 all in Troostwood, a subdivision in Kansas City, Jackson County, Missouri, being more particularly described as follows: Beginning at a point located 5.00 feet north of the southwest corner of said Lot 29, being also a point on the east right of way line of Troost Avenue, as now established; thence North 2 38'43" East along the west line of said Lots 29 through 4, inclusive, and along said east right of way line, a distance of 918.28 feet to a point on the east right of way line of Troost Avenue, as now established; said point being 61.82 feet south of the northwest corner of said Lot 2; thence South 87 21'17" East 140.95 feet to a point; thence South 12 32'33" East 25.90 feet to a point on the south line of said Lot 4, 25.00 feet west of the southeast corner thereof; thence South 87 21'29" East along the south line of said Lot 4, 25.00 feet to the southeast corner thereof; thence South 17 29'49" East along the easterly line of said Lot 5, 11.91 feet (11.90 plat) to an angle point in the easterly line of said Lot 5; thence South 32 20'49" West, a distance of 33.96 feet (33.75 plat); thence South 13 25'01" West, 10 feet to a point on the north line of Lot 58 of said Troostwood, being also a point on the southerly line of a pedestrian way as established by the plat of Troostwood; thence South 35 51'50" West along the westerly line of said Lot 58 and along the easterly line of said Lot 6, 38.76 feet (38.54 feet plat) to the southeast corner of said Lot 6; thence South 2 38'43" West along the west line of Lot 6 and along the east line of said Lots 7 through 29 inclusive, a distance of 810 feet to a point located 5.00 feet north of the southeast corner of said Lot 29; thence North 87 30'08" West a distance of 136.90 feet (137 feet plat) to the point of beginning. To be replatted and known as Lots 1, 2, and Tract A Troostwood Townhomes.

 

is hereby rezoned from District R-4 (Low Apartments) to District URD (Urban Redevelopment District), all as shown outlined on a map marked Section 65.010A2674, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the developer make any improvements as required by the City

Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer provide fire protection as required by the Fire Department.

 

5. That the developer install, loop, remove and/or relocate water mains as required by the Water Services Department.

 

6. That the developer contribute $2,815.52 in lieu of parkland dedication for 28 units in satisfaction of Section 66-128 of the Subdivision Regulations.

 

7. That the developer submit a site plan for each phase to the Director of the Department of City Development for approval prior to the issuance of a building permit. The site

plans shall include: development plan information, property uses, setback distances,

lighting, landscaping, signage and architectural characteristics.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 961107, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
