ORDINANCE NO. 080913
Approving the 150 Highway &
Botts Road PIEA General Development Plan for an area of approximately 186 acres
generally located at the northwest corner of Missouri Highway 150 and Botts
Road; and declaring the area included in such plan to be a blighted and
insanitary area in need of redevelopment and rehabilitation pursuant to the
Missouri Planned Industrial Expansion Authority (PIEA) Law 100.300-100.620.

WHEREAS, the
Planned Industrial Expansion Authority of Kansas City, Missouri did prepare or
cause to be prepared the 150 Highway & Botts Road PIEA General Development
Plan and recommended that the Council approve the finding of blight and approve
the General Development Plan for the area; and
WHEREAS, the
City Plan Commission has reviewed and recommended approval of the finding of
blight and of the 150 Highway & Botts Road PIEA General Development Plan on
September 2, 2008, as evidenced by its disposition of the case and has found
said plan to be in conformance with the general plan for the development of the
community as a whole; and
WHEREAS, Section
100.400, RSMo, authorizes the Council to approve a general development plan and
a designation of blight if the Council finds that the plan is feasible and in
conformity with the general plan for the development of the community as a
whole; and
WHEREAS, the
Council has approved the general development plan, as amended; NOW, THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the Council declares the area of approximately 186 acres generally located at
the northwest corner of Missouri Highway 150 and Botts Road, and more
specifically described by metes and bounds as follows:
All that part of the
South 1/2 of Section 27, Township 47, Range 33, being partially in the City of Grandview
and partially in the City of Kansas City, Jackson County, Missouri, being more
particularly described as follows: Commencing at the southeast corner of said Section
27; thence North 0-09'-34" East, along the east line of said Section 27,
a distance of 611.62 feet; thence North 89-50'-26" West, a distance of
20.00 feet to a point on the west line of Botts Road, as now established, said
point also being the northern terminus of the Botts Road right-of-way, as
described in Document No. 1999K0067541, said point being the point of beginning
of the tract of land to be herein described; thence South 25-42'-17" West,
along said right-of-way line, a distance of 90.56 feet; thence South
0-09'-34" West, continuing along said right-of-way line, a distance of
433.17 feet to a point on the north right-of-way line of Missouri Highway No.
150, as described in the aforesaid document; thence the following courses along
said north right-of-way line: South 64-34'-48" West, a distance of 83.58
feet; thence North 89-58'-21" West, a distance of 219.87 feet; thence South
81-20'-21" West, a distance of 165.94 feet; thence North 89-58'-21"
West, a distance of 82.02 feet; thence North 78-07'-15" West, a distance
of 251.42 feet; thence North 89-56'-40" West, a distance of 164.04 feet;
thence South 72-31'-46" West, a distance of 172.00 feet; thence North
89-58'-21" West, a distance of 164.04 feet; thence North 80-08'-12"
West, a distance of 83.36 feet; thence North 89-56'-15" West, a distance
of 83.09 feet; thence North 0-01'-39" East, a distance of 54.13 feet;
thence North 89-56'-15" West, a distance of 131.29 feet; thence South
0-01'-39" West, a distance of 54.13 feet; thence North 89-58'-21" West,
a distance of 32.21 feet; thence South 80-04'-25" West, a distance of

thence South 89-56'-39" West, a distance of 426.51 feet; thence North
87-32'-42" West, a distance of 57.46 feet, to a point on the east line of
a tract of land described in Document No. 98K28961 in Book K3209 at page 68;
thence North 6-39'-59" East, along said east line and departing said
right-of-way line, a distance of 2335.94 feet, to an angle point in said east
line; thence North 68-00'-34" East continuing along said east line, a
distance of 532.50 feet; thence North 89-44'-38" East along the south
line of said tract of land, a distance of 2635.56 feet, to a point on the east
right-of-way line of said Botts Road; thence South 0-09'-34" West, along
said east right-of-way line, a distance of 1957.40 feet, to the point of
beginning. Containing 185.643 acres, more or less.
to be a blighted, unsanitary or
undeveloped industrial area in need of industrial development as defined in
Section 100.310, RSMo, which constitutes an economic or social liability or a
serious and growing menace, which is injurious to the public health, safety,
morals, economy and welfare of the residents of Kansas City, and finds that the
elimination or prevention of the detrimental conditions in such area by the
commercial development of such area is necessary and in the interest of the
public health, safety, morals, economy and welfare of such residents.
Section 2. That
the Highway 150 & Botyts Road PIEA General Development Plan being that area
of approximately 186 acres generally located at the northwest corner of
Missouri Highway 150 and Botts Road, is hereby approved. A copy of said plan is
attached to this ordinance and is made a part hereof.
Section 3. That
the Council has duly made the findings necessary for compliance with Section
100.300-100.620, RSMo.
Section 4. That
said General Development Plan is hereby found to be feasible and in conformance
with the general plan for the development of the community as a whole.
Section 5. That
the ad valorem tax exemption benefits as authorized in Section 100.570, RSMo,
are hereby extended to the plan area to the extent and in the manner as
provided for in said General Development Plan, and subject to the execution of
a development agreement with Planned Industrial Expansion Authority and the
developer.
