ORDINANCE NO. 011761

 

Approving an amendment to a previously approved Community Unit Project on approximately a 242.96 acre tract of land generally located on the south side of Missouri Highway 291 at N. Flintlock Road, for the purpose of deleting an approximately 99.65 acre tract of land from said Community Unit Project. (11771-CUP-5)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved Community Unit Project on approximately a 242.96 acre tract of land generally located on the south side of Missouri Highway 291 at N. Flintlock Road, and more specifically described as follows:

 

A tract of land in the Southwest Quarter and the Southeast Quarter of Section 35, Township 52, Range 32 and the Northeast Quarter and the Northwest Quarter of Section 2, Township 51, Range 32, all in Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the northeast corner of said Southwest Quarter; thence North 89E031'11" West, along the north line of said Southwest Quarter, 148.50 feet to the true point of beginning of the tract to be herein described; thence South 0E42'00" West, 181.50 feet; thence South 89E31'11" East, 148.50 feet to a point on the east line of said Southwest Quarter; thence South 0E42'00" West, along said east line, 433.75 feet; thence South 6E46'31" West, 304.39 feet; thence South 70E41'56" East, 1239.83 feet; thence southeasterly, along a curve to the left, having an initial tangent bearing of South 63E19'40" East, a radius of 1185.92 feet, a central angle of 7E26'46", an arc distance of 154.12 feet; thence South 70E41'56" East, 1078.54 feet; thence southeasterly along a curve to the right, tangent to the last described course, having a radius of 7599.14 feet, an arc distance of 363.11 feet to a point on the east line of said Southeast Quarter; thence South 0E55'57" West, along said east line, 783.81 feet to the southeast corner of said Southeast Quarter; thence North 89E48'28" West, along the south line of said Southeast Quarter, 171.84 feet to the northeast corner of said Northeast Quarter; thence South 0E45'44 West, along the east line of said Northeast Quarter, 1339.93 feet to the southeast corner of the North One-Half of said Northeast Quarter; thence North 89E31'18" West, along the south line of said North One-Half, 2578.52 feet to the southwest corner of said North One-Half; thence South 0E26'29" West, along the east line of said Northwest Quarter, 1334.55 feet to the southeast corner of said Northwest Quarter; thence North 89E31'17" West, along the south line of said Northwest Quarter, 645.28 feet to the southwest corner of Lot 1, Flintlock Acres, a subdivision in said city, county and state, thence North 00E26'04" West along the west line of said Lot 1, a distance of 250.04 feet; thence South 89E30'47" East, along the north line of said Lot 1, a distance of 595.31 feet to a point on the westerly right of way line of Flintlock Road, as now established; thence North 0E26'29" East along the westerly right of way line of said Flintlock Road, 11081.57 feet; thence continuing along the westerly right of way line of said Flintlock Road and along a curve to the left, said curve being tangent to the last described course and having a radius of 1900.00 feet, an arc distance of

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval when the first plat is submitted and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

7. That the developer extend water mains as required by the Water Services Department.

 

8. That the developer extend sanitary sewers as required by the Department of Public Works.

 

9. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

10. That the developer receive the approval of the Board of Zoning Adjustment for any neighborhood identification signs prior to the issuance of a sign permit.

 

11. That the developer construct temporary cul-de-sacs for each phase as required by the Department of Public Works.

12. That the developer contribute $20,854.43 in lieu of parkland dedication (125 single family lots x 3.7 x 0.006 = 2.78 acres - 1.17 acres private open space = 1.61 acres x $12,953.06) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

13. That the developer submit covenants, conditions and restrictions with the final plat to the Law Department for approval for the maintenance of private open space.

 

14. That the developer submit a final plan for the private open space to the City Plan Commission for approval, including plans for grading and landscaping.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 011761, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
