COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 951153

 

Approving the preliminary plat of Estates of Somerset Hills on a 28 acre tract of land located on the south side of Santa Fe Road and east of Wornall Road. (SD 0699)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Estates of Somerset Hills on a 28 acre tract of land located on the south side of Santa Fe Road and east of Wornall Road, and more specifically described as follows:

 

A tract of land lying in the Southwest Quarter of Section 8, Township 47, Range 33, in Kansas City, Jackson County, Missouri, being bounded and described as follows: Commencing at the northeast corner of said Southwest Quarter, thence South 0 00'00" East along said east line, 487.00 feet to the true point of beginning of the tract to be herein described; thence South 0 00'00" East, along said east line, 1569.63 feet; thence North 88 27'45" West, 1265.54 feet to a point on the east right of way line of Wornall Road, as now established; thence North 0 10'30" East along said east right of way line, a distance of 529.98 feet; thence South 88 27'45" East, 606.89 feet; thence North 0 05'15" East, 868.04 feet; thence North 76 47'00" East, 289.43 feet; thence South 8 33'40" East, 326.98 feet; thence North 61 56'00" West, 170.03 feet; thence South 90 00'00" East 150.00 feet; thence North 0 00'00" West, 325.23 feet; thence North 76 47'00" East, 25.68 feet to the true point of beginning. Containing 27.43 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer shall dedicate 25 feet of right of way for Oak Street as required by the Department of Public Works so as to provide 25 feet of right of way as

measured from the centerline of Oak Street.

 

3. That the developer submit a storm drainage study for the entire development and that improvements be made as required by the City Engineer's Office.

 

4. That the developer obtain a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer dedicate 100 feet of right of way for Martha Truman Road.

 

6. That the developer dedicate a total of 30 feet from centerline on the south side of Santa Fe Trail.

 

7. That the developer improve the north two lanes of Martha Truman Road and grade full width of the right of way.

 

8. That the developer improve the south half of Santa Fe Trail to collector street standards.

 

9. That the developer improve the east half of Wornall Road to secondary arterial street standards.

 

10. That the developer submit a street tree planting plan with the final plat and approved by the City Forester.

 

11. That the developer submit a street sign with the final plat.

 

12. That the developer dedicate as parkland the area south of proposed Martha Truman Road and that a Phase 1 environment audit be performed.

 

13. That the developer extend water mains as required.

 

14. That the developer provide fire protection and hard-surface roads prior to construction beyond foundations.

 

A copy of said preliminary plat is on file in the office of the City Clerk under Document No. 951153, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
