ORDINANCE NO. 130224

 

Amending Ordinance No. 120286, which rezoned an area of approximately 14.69 acres generally located about 800 feet south of N.W. 64th Street (M-45) on the west side of N. Cosby Avenue from District R-6 to District MPD, to eliminate a condition requiring dedication of right of way. (5857-MPD-49)

 

WHEREAS, Ordinance No. 120286 rezoned an area of approximately 14.69 acres generally located about 800 feet south of N.W. 64th Street (M-45) on the west side of N. Cosby Avenue from District R-6 to District MPD, and approved a preliminary development plan for 298 residential multifamily units in seven buildings; and

 

WHEREAS, one of the conditions on that approval ordinance, condition 20 (subsection B.20), required that the developer dedicate additional right-of-way on the south side of N.W. 63rd Street so as to provide a minimum of 43.5 feet of right-of-way as measured from the street centerline to provide for a collector street with 11 feet wide travel lane, 3.5 feet wide clearance for parking maneuvering, 18 feet wide 45 degree back-in angle parking stalls (including gutter), one foot width for curb, and 10 feet width for sidewalk, streetlights, and utilities; and

 

WHEREAS, the additional right of way required by condition 20 was needed for back-in angled parking that the developer had proposed on the plan; and

 

WHEREAS, the developer has replaced the back-in angled parking with parallel parking, and the additional right of way is no longer required by the City; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY;

 

Section 1. That Ordinance No. 120286 is hereby amended by deleting subsection B.20, which eliminates the requirement for the dedication of additional right of way, as stated in said subsection.
