ORDINANCE NO. [R-2013-00127]

 

Declaring it necessary to re-establish the street grades for a segment of Front Street; establishing the right-of-way for Front Street and Riverfront Drive; and directing the City Clerk to publish notice and to record this ordinance.

 

WHEREAS, the Council finds that for the public good it is necessary that the grades on Front Street, in Kansas City, Jackson County, Missouri, be established; and

WHEREAS, a portion of said property owned by the city is being established for street purposes as part of said redesigned Front Street, and Riverfront Drive; and

WHEREAS, the city hereby dedicates said Front Street, and Riverfront Drive for street purposes; and

WHEREAS, the Council further finds the Director of Public Works, has caused the plans and specifications for Project Number 898204ST [Federal Project No. ARRA-ES04 (038)], Front Street Roadway improvements to be prepared; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That finding it necessary to re-establish grades on redesigned Front Street, located between the Missouri Highway No. 9 and I-35/29, and cross street of Riverfront Drive, all in Kansas City, Jackson County, Missouri, the Council hereby directs that the City Clerk cause a notice of said grade changes to be published in the newspaper doing the city printing, on each day of issue of said newspaper for a period of ten (10) days, starting on or about the date following the passage of this ordinance, and providing a period of thirty (30) days for remonstrance starting the same day as the first day of the publication.

Section 2. The street right of way shall be used by Kansas City as the location of street improvements constructed, and maintained therein including any necessary appurtenances to it.

Section 3. That grades shall be of the nature described and specified in, and shall be done in accordance with the plans and specifications prepared and certified by the City Engineer under the supervision of the Director of Public Works and identified as KCMO Project Number 898204ST [Federal Project No. ARRA-ES04 (038)] Front Street Roadway Improvements Project, the same being on file in the Office of the Director of Public Works and being incorporated herein by reference.

Section 4. That the establishing of grades is hereby authorized to commence when this ordinance becomes effective, and shall be built in accordance with the plans and specifications as described in Section 2 of this ordinance; locating and defining the grade points of said streets on the proposed project centerline stationing, as found on said plans, said centerline being described by intersection, control point, stationing; said grade points being connected by straight grades (tangents) or vertical curves between such grade points, the elevations of which are herein given below in feet (NAVD88 directrix), along with other pertinent alignment data, to-wit:

All grade points are on the new centerline of Front Street, as herein described, and as found in said plans in the office of the Director of Public Works, and are shown to wit:

Baseline/centerline of Front Street is described as follows:

Bearings are referenced to grid north of the Missouri state plane coordinate system, 1983, west zone. Stations below are as referenced in said street plan for 898204ST [Federal Project No. ARRA-ES04 (038)].

Section 6. That the City hereby establishes right of way for Riverfront Drive as follows:

A tract of land located in fractional Sections 28 and 33, Township 50 North, Range 33 West, in Kansas City, Jackson County, Missouri being that tract devoted for public use for street purposes for relocation of River Front Road at Paseo River Bridge Connection to Interstate Routes I-29 and I-35, in Kansas City, Jackson County, Missouri by Ordinance #42446 passed March 30, 1973, said tract being more particularly described as follows:

 

Commencing at the northeast corner of the north half of the aforementioned fractional Section 33; thence S 02 degrees 28 minutes 37 seconds W along the east line of said Section 33, a distance of 203.62 feet; thence N 87 degrees 31 minutes 23 seconds W, a distance of 3218.26 feet to a point on the northerly line of said tract, said point being the most easterly point of said tract, said point also being the POINT OF BEGINNING of the herein described tract; thence S 37 degrees 29 minutes 03 seconds W along the southeasterly line of said tract, a distance of 120.00 feet to a point on the southerly line of said tract; thence northwest, west and southwest the following four courses along said southerly line, N 52 degrees 30 minutes 57 seconds W, a distance of 298.65 feet to the beginning of a curve concave to the southwest having a radius of 460.87 feet; thence northwesterly, westerly and southwesterly 534.90 feet along said curve through a central angle of 66 degrees 29 minutes 58 seconds; thence S 60 degrees 59 minutes 05 seconds W, a distance of 440.57 feet to the beginning of a curve concave to the southeast having a radius of 460.87 feet; thence southwesterly 343.51 feet along said curve through a central angle of 42 degrees 42 minutes 19 seconds to the most southerly point of said tract; thence N 71 degrees 43 minutes 14 seconds W along the southwesterly line of said tract, a distance of 120.00 feet to a point on the northerly line of said tract, said point being the beginning of a non-tangent curve concave to the southeast having a radius of 580.87 feet and an initial tangent bearing of N 18 degrees 16 minutes 46 seconds E; thence northeasterly, easterly and southeasterly along said northerly line, the following four courses; 432.95 feet along said curve through a central angle of 42 degrees 42 minutes 19 seconds; thence N 60 degrees 59 minutes 05 seconds E, a distance of 440.57 feet to the beginning of a curve concave to the southwest, having a radius of 580.87 feet; thence northeasterly, easterly and southeasterly 674.18 feet along said curve through a central angle of 66 degrees 29 minutes 58 seconds; thence S 52 degrees 30 minutes 57 seconds E, a distance of 298.65 feet to the POINT OF BEGINNING of said tract containing 207,839 square feet or 4.77 acres more or less.

 

Section 7. All easements located within street right of way are subordinate to street right of way.

Section 8. That this ordinance shall become effective as provided in Section 88.917, RSMo.

Section 9. That upon the effective date of this ordinance, the City Clerk is hereby directed to cause this ordinance to be recorded in the Office of the Recorder of Deeds for Kansas City, Jackson County, Missouri.
