ORDINANCE NO. 971022

 

Repealing Ordinance No. 911486 granting a temporary permit to Mayflower/Laidlaw for operation of transit bus services from Johnson County, Kansas on the streets of the City, and enacting in lieu thereof a new Ordinance of like subject matter.

 

WHEREAS, the permit fee of $500.00 per vehicle required by Section 3 of Ordinance 911486 is one of the barriers to an effective Regional Transit System that should be removed; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Ordinance No. 911486 is hereby repealed.

 

Section 2. That Mayflower Contract Services, Inc., is hereby granted, subject to compliance with all of the terms and conditions hereof, the temporary right and privilege to operate a public transit bus service on the streets of Kansas City, Missouri, in conjunction with the transit bus service it operates pursuant to a contract with Johnson County, Kansas. The permittee is granted no property interest capable of being encumbered or assigned.

 

Section 3. That such transit bus service shall be operated over only such routes and shall serve only such stops as shall be established by the Director of Public Works.

 

Section 4. That the permittee shall indemnify and hold the City, its officers, agents and employees, harmless from all liability, loss or damage resulting to any persons or property caused by or arising out of the permittee's operations hereunder; and shall provide the City with a certificate of liability insurance by a carrier approved by the Director of Finance covering the indemnification agreement having a combined single limit of five million dollars. The insurance policy, by separate endorsement, shall name the City as an additional insured and agree to provide thirty (30) days notice to the City prior to any change in, or cancellation of, said insurance.

 

Section 5. The rights and privileges granted hereunder shall continue until revoked by action of the Council and shall automatically terminate upon the failure of the permittee to comply, or continue to comply, with any of the conditions hereof and upon the expiration or earlier termination of the permittee's contract for the public transit bus service with the Board of County Commissioners of Johnson County, Kansas.
