COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 110070

 

Approving the 155th & Kensington PIEA Planning Area General Development Plan on about 54 acres generally bounded by Fairchild Drive and E. 157th Street on the north, Kensington Avenue and Elmwood Avenue on the east, the city limits of Kansas City, Missouri and Wright Street on the south, and Fairchild Drive and Norton Avenue on the west; declaring that area a blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Missouri Planned Industrial Expansion Authority Law, Sections 100.300-100.620, RSMo; and authorizing the transfer of certain city-owned property to the Planned Industrial Expansion Authority. WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri (the “Authority”) did prepare or cause to be prepared a General Development Plan for the 155th & Kensington PIEA Planning Area (“Plan”) and recommended that the Council approve the finding of blight and approve the General Development Plan for the area; and

 

WHEREAS, the City Plan Commission reviewed the finding of blight and the Plan for the 155th & Kensington PIEA Planning Area (“Planning Area”) on January 18, 2011, and recommended approval of the finding of blight for the Planning Area and found the Plan to be in conformance with the general plan for the development of the community as a whole; and

 

WHEREAS, Section 100.400, RSMo, authorizes the Council to approve a general development plan and a designation of blight if the Council finds that the plan is feasible and in conformity with the general plan for the development of the community as a whole; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council declares that portion of the following described area of approximately 54 acres lying above the top of the Winterset Ledge of limestone rock generally bounded by Fairchild Drive and E. 157th Street on the north, Kensington Avenue and Elmwood Avenue on the east, the city limits of Kansas City, Missouri and Wright Street on the south, and Fairchild Drive and Norton Avenue on the west, more specifically described by metes and bounds as follows:

 

A tract of land situated in the West Half (1/2) of Section 2, Township 46 North, Range 33 West of the Fifth Principal Meridian and the East Half (1/2) of Section 3, Township 46 North, Range 33 West of the Fifth Principal Meridian all in the City of Kansas City, Cass County, Missouri and being more particularly described as follows:

 

COMMENCING at the Northwest corner of said Section 2 (Found 5/8" Iron Bar with Aluminum Cap); thence South 02 degrees 43 minutes 18 seconds West along the West line of said Section 2 a distance of 1692.64 feet; thence South 87 degrees 16 minutes 42 seconds East a distance of 429.30 feet to a point on the East right of way line of Kensington Avenue, as road presently exists (Found 2-1/2" Alum. Mon. Stamped U.S.C.E.); thence North 02 degrees 40 minutes 42 seconds East along said East right of way line a distance of 142.21 feet, said point also being the POINT OF BEGINNING of the tract of land to be more particularly described herein; thence North 62 degrees 40 minutes 38 seconds East a distance of 377.88 feet; thence South 27 degrees 05 minutes 23 seconds East a distance of 123.43 feet; thence South 62 degrees 42 minutes 42 seconds West a distance of 46.25 feet; thence South 27 degrees 20 minutes 59 seconds East a distance of 292.03 feet; thence North 87 degrees 06 minutes 33 seconds West a distance of 97.47 feet (Found 2-1/2" Alum. Mon. Stamped U.S.C.E.); thence North 27 degrees 20 minutes 59 seconds West a distance of 243.03 feet (Found 2-1/2" Alum. Mon. Stamped U.S.C.E.); thence South 62 degrees 42 minutes 42 seconds West a distance of 318.03 feet to a point on the East right of way line of Kensington Avenue, as road presently exists (Found 2-1/2" Alum. Mon. Stamped U.S.C.E.); thence South along said East right of way line of Kensington Avenue, as now established, and along the Southerly extension of said line to its intersection with the city limits of Kansas City, Missouri, as now established; thence West along said city limit of Kansas City, Missouri, as now established, to its intersection with the southerly extension of the West right of way line of Norton Avenue, as road presently exists; thence North along said right of way line of Norton Avenue, as now established, to its intersection with the South right of line of Wright Street, as road presently exists; thence West along said North right of way line of Wright Street, as now established, to its intersection with the West right of way line of Fairchild Drive, as road presently exists; thence North and Northeast along said right of way line of Fairchild Drive, as now established, and along the Easterly extension of said line to its intersection with the East right of way line of Kensington Avenue, as road presently exists; thence South along said East right of way line of Kensington Avenue, as now established, to the POINT OF BEGINNING. Subject to the rights of the public, easements, restrictions and utilities herein.

 

to be a blighted, insanitary or undeveloped industrial area in need of industrial development as defined in Section 100.310, RSMo, which constitutes an economic or social liability or a serious and growing menace, which is injurious to the public health, safety, morals, economy and welfare of the residents of Kansas City, and finds that the elimination or prevention of the detrimental conditions in such area by the commercial development of such area is necessary and in the interest of the public health, safety, morals, economy and welfare of such residents. 

 

Section 2. That 155th & Kensington PIEA Planning Area General Development Plan prepared by the Authority and recommended to the Council is intended to and shall affect and be applicable to only the real property specifically described in Section 1 above and, as so modified, is hereby approved. A copy of said plan is attached to this ordinance and is made a part hereof.  

 

Section 3. That the Council has duly made the findings necessary for compliance with Section 100.300-100.620, RSMo. 

 

Section 4. That the Plan is hereby found to be feasible and in conformance with the general plan for the development of the community as a whole. 

 

Section 5. That the ad valorem tax exemption benefits as authorized in Section 100.570, RSMo, are hereby extended to the Planning Area to the extent and in the manner as provided for in said Plan, and subject to the execution of a development agreement with Planned Industrial Expansion Authority of Kansas City, Missouri, and the developer. 

 

Section 6. Pursuant to Sections 100.530 and 100.540, RSMo, the Council hereby authorizes the City Manager or his designee to execute any and all documents necessary to transfer the city owned property within the Planning Area to the Authority for disposition in connection with the Plan.
