Approving a preliminary plat of Amended
Preliminary Plat of Wallstreet Tower Condominiums on a 0.75 acre tract of land
located at 1101 Walnut Street. (SD 1148 C)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat of Amended Preliminary Plat of Wallstreet Tower
Condominiums on a 0.75 acre tract of land located at 1101 Walnut Street, and
more specifically described as follows:
All of Block 1,
Wallstreet Tower Condominiums and Lot 1, Wallstreet Garage Condominium, Kansas
City, Jackson County, Missouri, also described as follows: Beginning at the
Northeast corner of Block 1, Wallstreet Condominium, a subdivision in Kansas
City, Jackson County, Missouri; thence S 22307W for 144.00 feet to the
Southeast corner of Block 1; thence N 873308W for 110.50 feet to the East
right of way line of Walnut Street (76r/w); thence N 22307E along said
right of way line for 144.00 feet to the Northwest corner of Block 1; thence S
873308E for 110.50 feet to the Point of Beginning; also Beginning at the
Southeast corner of Lot 1, Wallstreet Garage Condominium; thence N 873308W
for 115.50 feet to the Southwest corner of Lot 1; thence N 22307E along the
West line of Lot 1 to the center line of the Party Wall of the South wall of
the 6 1/2 story building on Lot 81, Swopes Addition; thence Easterly through
the center of said party wall to the East line of Lot 81; thence S 22307W to
the Point of Beginning.
is hereby approved, subject to
the following conditions:
1.
That the developer cause the area to be platted and processed in
accordance with Chapter 66, Code of Ordinances of the City of Kansas City,
Missouri, commonly known as the Subdivision Regulations.
2.
That the developer submit a letter from a licensed civil
engineer, licensed architect, or licensed landscape architect, who is
registered in the State of Missouri, stating the condition of the sidewalks,
curbs, and gutters. The letter must identify state of repair as defined in
Chapters 56 and 64, Code of Ordinances, for the sidewalks, curbs, and gutters.
It shall identify the quantity and location of sidewalks, curbs, and gutters
that need to be constructed, repaired, or reconstructed. The developer shall
secure permits to repair or reconstruct the identified sidewalks, curbs, and
gutters as necessary along all development street frontages, as required by
Development Services, prior to recording the plat.
3.
That the developer submit covenants, conditions and restrictions
to Development Services for review by the Law Department for approval for the
maintenance of common elements.
4.
That the developer contribute $126.11 in lieu of parkland
dedication for one multifamily unit.
5.
That the developer receive any necessary variances from the Board
of Zoning Adjustment.
A copy of the preliminary plat is
on file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices and hearings required by the
Subdivision Regulations have been given and had.
