COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 150116

Approving a modification to the Central Business District Urban Renewal Plan by approving a declaration of blight for the properties located at 911 Main Street and 921 Main Street and listing these properties as acquisition tracts within the Plan, as required by the Land Clearance for Redevelopment Authority Law of Missouri.

 

WHEREAS, Section 99.430 Revised Statutes of Missouri, provides that the City Council may approve a declaration of blight and approve an urban renewal plan for the same area simultaneously; and

WHEREAS, the City Council originally approved the Central Business District Urban Renewal Plan by Ordinance No. 36287 passed on January 17, 1969, as later amended (the “Plan”), the purpose of which is to eliminate the spread, development and recurrence of the blighted and insanitary conditions within the Central Business District Urban Renewal Area as such area is defined in the Plan (the “Area”); and

WHEREAS, the Land Clearance for Redevelopment Authority of Kansas City, Missouri (the “Authority”) has prepared or caused to be prepared a blight study (the “Blight Study”) for two parcels, 911 Main Street and 921 Main Street (also known as the Commerce Tower and its adjacent parking garage) (collectively, the “Commerce Tower”), which is located within the existing Area; and

WHEREAS, the Authority has determined, on the basis of investigations and surveys conducted by it or at its direction, that the Commerce Tower is “blighted” within the definition of such term pursuant to Section 99.320, RSMo; and

WHEREAS, said properties are blighted due to unsafe conditions, deterioration of site improvements, existence of conditions which endanger life or property by fire and other causes, and a combination of such factors so as to constitute an economic or social liability to the public health, safety, morals or welfare; and

WHEREAS, the Authority did on February 5, 2015, adopt a resolution recommending approval of a modification to the Plan, with the modification approving a declaration of blight for the Commerce Tower and listing these properties as acquisition tracts within the Plan; and

WHEREAS, it is desirable and in the public interest that the City Council make a determination that the area comprised of 911 Main Street and 921 Main Street is blighted; and

WHEREAS, it is desirable and in the public interest to modify the Plan with the modification approving a declaration of blight for the Commerce Tower area and listing the Commerce Tower as acquisition tracts within the Plan; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the City Council approves the Blight Study and makes a determination that Commerce Tower (comprised of the two parcels at 911 Main Street and 921 Main Street) is a blighted area under Section 99.320 Revised Statutes of Missouri, of the Land Clearance for Redevelopment Authority Law.

Section 2. That the Central Business District Urban Renewal Plan be amended such that the properties located at 911 Main Street and 921 Main Street are listed as acquisition tracts within the Plan.

Section 3. That the City Council has duly made the findings necessary for compliance with Sections 99.320 and 99.430, Revised Statutes of Missouri, as amended.

Section 4. That the Plan modification is hereby found to be feasible and in conformance with the general plan for the development of the community as a whole.
