ORDINANCE NO. 900664

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2350, rezoning an area generally located east of State Line Road, south of 39th Street, west of Southwest Trafficway, and north of Westport Road from District R-2b (two-family dwelling) to District R-2a (two- family dwelling - low density).

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance is hereby amended by enacting a new section to be known as Section 65.010A2350, rezoning an area generally located east of State Line Road, south of 39th Street, west of Southwest Trafficway, and north of Westport Road from District R-2b (two-family dwelling) to District R-2a (two-family dwelling - low density), said section to read as follows:

 

Section 65.010A2350. That an area legally described as:

 

Beginning at the Southeast corner of Lot 3 Wiedenmann Place. Thence West to the Southwest corner of Lot 15 Epperson Place said point is also on the East line of Holly Street. Thence Southwest to the Southwest corner of Lot 13 Ellison Park. Thence West to the Southwest corner of Lot 6 Ellison Place, said point also lying on the East line of Mercier Street. Thence Southwest to the Southeast corner of Lot 43 Epperson Place. Thence West to a point on the East line of Terrace Street, said point also being the Southwest corner of Lot 74 Epperson Place. Thence West to the Southeast corner of Lot 79 Epperson Place, said point also lying on the West line of Terrace Street. Thence West to the Southwest corner of Lot 85 Mellier Heights, said point also lying on the East line of Wyoming Street. Thence West to the Southeast corner of Lot 80 Mellier Heights, said point also lying on the West line of Wyoming Street. Thence West to the Southwest corner of Lot 75 Mellier Heights, said point also lying on the East line of Genessee. Thence West to a point on the West line of Genessee Street, said point being a distance of 80 feet North of the North line of Westport Road. Thence West to a point on the East line of Bell Street, said point being a distance of 80 feet North of the North line of Westport Road. Thence West to a point on the West line of Bell Street, said point being a distance of 70 feet North of the North line of Westport Road. Thence West a distance of 114.67 feet, said point being a distance of 70 feet North of the North line of Westport Road. Thence North to a point which is a distance of 10 feet South of the Southeast corner of Lot
8 Virginia Place. Thence West to a point on the East line of State Line Road, said point being a distance of 220.79 feet North of the North line of Westport Road. Thence North on said East line of State Line Road to a point, said point being the Northwest corner of Lot 15 Muehlebach Place. Thence East to the Southeast corner of Lot 24 Muehlebach Place, said point is also lying on the West line of Bell Street. Thence following said East line of Bell Street to the Northeast corner of Lot 24 Muehlebach Place. Thence West to a point on the Northwest corner of Lot 16 Muehlebach Place, said point also lying on the East line of State Line Road. Thence North along said East line of State Line Road to its intersection of the Westerly prolongation of the south line of Lot 11 Block 9 Mellier Place. Thence East to the Southeast corner of Lot 12 Block 9 Mellier Place. Thence North to the Northeast corner of Lot 12 Block 9 Mellier Place. Thence West to the Northwest corner of Lot 11 Block 9 Mellier Place, said point also lying on the East line of State Line Road. Thence East and Northeasterly along the North line of Lot 21 Esslinger Place to its intersection with the West line of Clark Avenue. Thence Southeasterly to a point on the East line of Clark Avenue, said point being a distance of 7.5 feet North of the Northwest corner of Lot 23 Frank J. Smiths Addition. Thence East to the West line of Southwest Trafficway said point being the Northeast corner of Lot 13 Frank J. Smiths Addition. Thence South along East line of said Lot 13 to the Southeast corner of Lot 13. Thence South to the Northeast corner of Lot 10 South Roanoke Annex, said point lying on the West line of Southwest Trafficway. Thence South along said West line a distance of 95 feet. Thence West following the right of way line of Southwest Trafficway a distance of 45񠠠 feet. Thence South following said west right of way line to the Southeast corner of Lot 6 South Roanoke Annex. Thence South to the Northeast corner of Westport Landing Condominium Subdivision. Thence South along the West right of way of Southwest Trafficway to the Southeast corner of Lot 20 Quimbys Addition. Thence South along said right of way to its intersection with the North line of 40th Terrace. Thence West a distance of 40 feet along said North line. Thence South to the Southeast corner of Lot 22 Quimbys Addition. Thence Southeasterly to the Northeast corner of Lot 10 Louis Vogel's 4th Addition. Thence Southeasterly a distance of 15 feet. Thence West a distance of 10 feet. Thence Southeasterly a distance of 12 feet. Thence Southwesterly 99 feet to a point on the West line of Clark Avenue. Thence Southeasterly along said West line a distance of 113 feet. Thence Southwesterly a distance of 173.25 feet to a point on the East line of Lot 6 Murphy's 1st Addition, said point being on a line 13 feet South of the Northeast corner of Lot 6 and parallel to the East line of Roanoke Road. Thence continuing Southeasterly on said parallel line to the Southeast corner of Lot 9 Louis Vogel's 3rd Addition. Thence Northeasterly to the Northeast corner of Lot 13 Louis Vogel's 3rd Addition. Thence Southeasterly along the East line of said Lot 13 to the Southeast corner of Lot 13, said line also being the West line of Southwest Trafficway. Thence following said West line of Southwest Trafficway Southwesterly a distance of 15 feet. Thence following same said West line Southwesterly a distance of 115 feet to a point on the South line of Lot 12 Louis Vogel's 3rd Addition, said point being a distance of 90 feet from the Southeast corner of said Lot 12. Thence Southwesterly to the Southwest corner of Lot 12 Louis Vogel's 3rd Addition, said point being on the East line of Roanoke Road. Thence Southwesterly to a point on the West line of Roanoke Road said point also being the Southeast corner of Lot 33 Gregg's Place. Thence continuing Southwest to a point on the South line of lot 20 Gregg's Place, said point being 15 feet Southwest of the Southeast corner of said Lot 20. Thence South to the Southeast corner of Lot 3 Wiedenmann Place, said point being the point of beginning.

 

EXCEPT THE FOLLOWING: Louis Vogel's 3rd Addition Lot 15 except the East 200 feet of the South 130 feet and except West 41st Place and including the East 1/2 of the vacated alley North of and adjacent to said Lot 15. Also, Gregg's Place Lots 1 thru 3 and all of the vacated alley North and adjacent and Louis Vogel's 3rd Addition east 200 feet of the South 130 feet Lot 15. Also, Lot 21 Mellier Place.

 

 

is hereby rezoned from District R-2b (two-family dwelling) to District R-2a (two-family dwelling - low density) all as shown outlined on a map marked Section 65.010A2350, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
