ORDINANCE NO. 010638

 

Declaring the area of approximately 47 acres generally bounded by Truman Road on the south, Cleveland Avenue on the west, the Kansas City Belt Railroad on the north, and a line approximately 1450 feet west of Van Brunt Boulevard on the east, a blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Planned Industrial Expansion law; approving an industrial development plan for the same area, said plan to be known as the Truman Road Business Park General Development Plan; and approving of the availability of ad valorem tax benefits for the area.

 

WHEREAS, Section 100.400, RSMo 1994, as amended, provides that a legislative body may approve a declaration of blight and approve an industrial development plan for the same area simultaneously; and

 

WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri, submitted an industrial development plan for an area generally bounded by Truman Road on the south, Cleveland Avenue on the west, the Kansas City Belt Railroad on the north, and a line approximately 1450 feet west of Van Brunt Boulevard on the east and recommended that the area is a blighted and insanitary area and in need of rehabilitation; and

 

WHEREAS, said area is blighted due to insanitary or unsafe conditions, deterioration of site improvements, and a combination of such factors as to constitute an economic or social liability to the public health, safety, morals and welfare; and

 

WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri, did on February 23, 2001, adopt Resolution No. 619, approving the Truman Road Business Park Area Factual Evidence of Blight, and Resolution No. 620, approving the Truman Road Business Park Area General Development Plan; and

 

WHEREAS, the City Plan Commission reviewed and recommended approval of the designation of blight and approval of the industrial development plan on April 17, 2001, as evidenced by its resolution recommending approval of the adoption of said plan and found said plan to be in conformance with the Master Plan for the development of the community as a whole, subject to certain conditions, a copy of which resolution is attached hereto and incorporated herein by reference as Exhibit A; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the proposed Planned Industrial Expansion Area identified as the Truman Road Business Park General Development Plan of approximately 47 acres generally bounded by Truman Road on the south, Cleveland Avenue on the west, the Kansas City Belt Railroad on the north, and a line approximately 1450 feet west of Van Brunt Boulevard on the east and more specifically described as:

 

In Kansas City, Missouri, parts of Sections 2 and 3, Township 49, Range 33: Beginning at the intersection of the north line of Truman Road with the east line of Cleveland Avenue, then north along east line of Cleveland Avenue to the south right of way of the Kansas City Belt Railway, then diagonally northeast along said right of way to its intersection with the south line of 12th Street, then east along the south line of 12th Street to the west property line of Elmwood Cemetery, then south along said property line to its intersection with the north line of Truman Road, then west along the north line of Truman Road to the point of beginning.

 

is a blighted area and in need of redevelopment and rehabilitation and is appropriate for a Planned Industrial Expansion Area project, and that the undertaking by the Planned Industrial Expansion Authority of Kansas City, Missouri, of surveys and plans for a Planned Industrial Expansion Area project of the character contemplated by Section 100.300, et seq., Revised Statutes of Missouri, 1994, as amended, ("RSMo"), and the proposed Planned Industrial Expansion Area is hereby approved.

 

Section 2. That the Industrial Development Plan for the Truman Road Business Park Area, as described above and which is known as the Truman Road Business Park General Development Plan, is hereby approved. A copy of the Truman Road Business Park General Development Plan is incorporated herein by reference and is on file in the office of the City Clerk under Document No. 010638.

 

Section 3. That the Council has duly made the findings necessary for compliance with Section 100.400, RSMo.

 

Section 4. That said Industrial Development Plan is hereby found to be feasible and in conformance with the General Plan for the development of the community as a whole.

 


Section 5. That the Council hereby approves of the availability of ad valorem tax benefits for the Truman Road Business Park Area pursuant to Section 100.570, RSMo.

 

Section 6. That the Council finds and declares that before taking any action on the proposed declaration of blight, Industrial Development Plan and ad valorem tax benefits, all public notices have been given and hearings have been held as required by law.
