ORDINANCE NO. 951290

 

Amending a previously approved development plan for Districts GP-1 and GP-2 on approximately a 225 acre tract of land generally located at the southeast corner of Interstate 29 and Missouri Highway 291 (N.W. Cookingham Drive). (6217-GP-6)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan for Districts GP-1 and GP-2 on approximately a 225 acre tract of land generally located at the southeast corner of Interstate 29 and Missouri Highway 291 (N.W. Cookingham Drive), and more specifically described as follows:

 

All that part of the West One-Half of the Northwest Quarter of Section 24 and all that part of the Northeast Quarter of Section 23, all in Township 52, Range 34, in Kansas City, Platte County, Missouri, more particularly described as follows:

 

Beginning at the southeast corner of the Northeast Quarter of said Section 23; thence North 89 44'03" West, along the south line of the Northeast Quarter of said Section 23; a distance of 2421.38 feet, to a point in the east right-of-way line of Interstate Highway No. 29, as now established; thence northerly and northwesterly, along the east right-of-way line of said Interstate Highway No. 29, and along a curve to the left having an initial tangent bearing of North 2 57'17" West and a radius of 11,589.16 feet, an arc distance of 1282.99 feet; thence North 02 53'36" East, continuing along said east right-of-way line, a distance of 918.11 feet; thence North 00 09'58" East, continuing along said east right-of-way line, a distance of 34.75 feet, to a point on the easterly right-of-way of I-29 said point being 299 feet south of the right-of-way of Missouri Route 291 and also being on the south line of the tract conveyed by deed recorded in Book 114 at page 231; thence South 89 43'33" East, along the south line of the tract so conveyed by said deed, and any prolongation thereof, a distance of 137.21 feet, to a point in the west line of the tract taken and condemned by the United Telephone Company of Missouri, in Case No. C13420, in the Circuit Court of Platte County, Missouri; thence South 00 16'27" West, along the west line of said Telephone Company tract, a distance of 1.00 feet, to the southwest corner thereof; thence South 89 43'33" East, along the south line of said Telephone Company tract, a distance of 203.55 feet, to the southeast corner thereof; thence North 00 16'27" East, along the east line of said Telephone Company tract, a distance of 214.06 feet, to a point on the south right-of-way line of State Highway No. 291 (formerly Highway 71 By-Pass), as now established; thence South 89 41'07" East, along the south right-of-way line of said State Highway No. 291, a distance of 863.96 feet; thence North 00 16'45" East, continuing along said south right-of-way line, a distance of 95.29 feet; thence South 89 43'15" East, continuing along said south right-of-way line, a distance of 641.06 feet, to a point of curvature; thence easterly and southeasterly, continuing along said south right-of-way line, and along a curve to the right having a radius of 2749.79 feet, an arc distance of 313.63 feet, to a point of tangency; thence South 83 11'09" East, continuing along said south right-of-way line, a distance of 97.46 feet; thence South 82 24'35" East, continuing along said south right-of-way line, a distance of 447.35 feet; thence South 81 39'29" East, continuing along said south right-of-way line, a distance of 340.12 feet; thence South 75 59'46" East, continuing along said south right-of-way line, a distance of 439.01 feet; thence South 62 24'51" East, continuing along said south right-of-way line, a distance of 451.48 feet, more or less, to a point in the east line of the West One Half of the Northwest Quarter of said Section 24; thence South 00 38'49" West, along said east line, a distance of 2087.06 feet, more or less, to the southeast corner of the West One Half of the Northwest Quarter of said Section 24; thence North 89 47'28" West, along the south line of the West One Half of the Northwest Quarter of said Section 24, a distance of 1327.62 feet, more or less, to the point of beginning.

 

The above described tract of land includes all of GATEWAY PLAZA and GATEWAY PLAZA SECOND PLAT, both being subdivisions of land in said city, county and state.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the developer make any improvements as required by the City

Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office prior to the commencement of any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer petition for the vacation of N.W. 119th Street.

 

6. That the developer submit a traffic study to the Department of Public Works for approval for the Phase II development as shown on the development plan.

 

7. That the developer install and/or extend water mains as required by the Water Services Department.

 

8. That the developer construct all-weather roads and provide for fire protection as required by the Fire Department prior to construction beyond footings and

foundations.

 

9. That the developer grant a noise and aviation easement to the City.

 

10. That the developer enter into a deferral agreement for the improvement of N.W. 119th Street to arterial street standards.

 

11. That the developer construct sidewalks on the east side of N. Ambassador Drive.

 

12. That the developer obtain the approval of the Missouri Highway and Transportation Department for any work within State right of way.

 

13. That the developer comply with the height restrictions of the KCI Airport Height Zoning Map.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 951290, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
