Authorizing a License Agreement with Google Inc., to install and maintain a wireless digital data communications.


TRANSPORTATION & INFRASTRUCTURE COMMITTEE recommends "ADVANCE AND DO PASS, DEBATE"
Ralph Davis, Public Works, testified that this ordinance would authorize the Director of Public Works to execute a License Agreement with Google, Inc. to install and maintain a wireless digital data communications network using equipment attached to poles in the public right of way. The term of the agreement is two (2) years, with possible additional terms of two (2) four year renewals. A copy of the License Agreement, in substantial form, is on file in the office of the Director of Public Works.

Estimating revenue in the amount of $1,395,256.00 in the Capital Improvement Fund; appropriating that amount to the Route 152 Trail Segment 8 and 9 account; authorizing the Director of Public Works to execute an amended and restated funding agreement with the Tax Increment Financing Commission; authorizing a contract with Pyramid Excavation and Construction, Inc. for approximately $1,537,000 for Route 152 Trail Segments 8 and 9, Fed No. STP-3400 (437); designating requisitioning authority; and recognizing this ordinance as having an accelerated effective date.


ADVANCE AND DO PASS AS A COMMITTEE SUBSTITUTE, DEBATE
Ralph Davis, Public Works, testified that this ordinance would authorize a contract and appropriate revenue in the amount of $1,395,256.00 in the Capital Improvement Fund for the construction of the Route 152 Trail; authorizing the Director of Public Works to execute an amended and restated funding agreement with the Tax Increment Financing Commission; authorizing a contract with Pyramid Excavation and Construction, Inc. for approximately $1,537,000 for Route 152 Trail Segments 8 and 9, Fed No. STP-3400 (437). The Route 152 Trail, Segment 8, begins near Line Creek Parkway and continues east to Platte Purchase Drive and the Route 152 Trail Segment 9, which begins near Platte Purchase Drive.

Amending Chapter 70, Code of Ordinances, by enacting a new Section 70-81, Authority of director of public works, to authorize the director of public works or the director’s delegates to enforce the provisions of Chapter 70, Code of Ordinances, Article V – Stopping, standing and Parking and Article VI – Abandoned vehicles and other personal property within the Kansas City Downtown Streetcar Transportation Development District .

Sherry McIntyre, Director of Public Works, testified that this ordinance would amend Chapter 70 Code of Ordinances by enacting a new subsection Section 70-643 amended by adding a new subsection establishing an appeal process for removal of vehicles by Director of Public Works.

 1. Public Works Street and Traffic Division will give a presentation on the Streetlight Program.
 
 Ralph Davis and Mahmoud Hadjian, of Public Works testified with an update of the Streetlight Program for the City of Kansas City. The update included the budget and needs of the program, streetlight and tree trimming maintenance, and equipment security information. A copy of the presentation is on file in the City Clerk's Office.
 
 2. There may be a general discussion regarding current Transportation and Infrastructure Committee issues.
 
 3. Pursuant to the following subsections of Section 610.021 of the Revised Statutes of Missouri, there may be a closed session to discuss: (1) legal matters, litigation, or privileged communications with attorneys, pursuant to subsection 1; (2) real estate, pursuant to subsection 2; (3) personnel, pursuant to subsection 3 and 13; and/or (4) sealed bids or proposals, pursuant to subsection 12.
 
 The City Clerk`s Office now has equipment for the hearing impaired for use with every meeting. To check out the equipment please see the secretary for each committee. Be prepared to leave your Driver`s License or State issued Identification Card with the secretary and she will give you the equipment. Upon returning the equipment your license will be returned.
