Rezoning an area of approximately 0.75 acres generally located at the southeast corner of W. 79th Street and Ward Parkway from Districts R-6 and B1-1 to District B1-1, and approving a development plan for the same area to permit an existing food and beverage retail sales establishment. (14768-P and 14768-P-1).

John Eckardt, City Planning and Development, gave the staff report on the Ordinance. It was noted that this is a companion to Resolution 170168. The market is classified as a food and beverage retail sales use, which is first permitted in District B1. The current zoning boundary appears to coincide with a former platted lot line and consequently lies through the southern portion of the market building itself leaving a small portion of the building and the parking area south of the building residentially zoned. The home used by the market for storage and office purposes is also residentially zoned. The rezoning request has been filed as a means of resolving a complaint regarding the illegal use of the home for uses accessory to the market. In addition to the market property, the applicant owns everal homes on the west side of Mercier St to the south and has used the home on the southern portion for uses accessory to the market for years. Aside from the office and storage use, the home’s rear yard is used for outdoor dining related to a food truck on the market property.

RESOLUTION - Amending the Waldo Area Plan on an approximately 0.25 acre tract of land, generally located at the southeast corner of W. 79th St and Ward Parkway, by changing the recommended land use from low density residential to retail/office. (256-S-5).

The market is classified as a food and beverage retail sales use, which is first permitted in District B1.
