Approving a Kansas City Brownfields Revolving Loan Fund subgrant in an amount not to exceed $96,000.00 for the Negro Leagues Baseball Museum, Inc. for abatement activities at the John “Buck” O’Neil Education and Research Center, 1824 Paseo Boulevard, Kansas City, Missouri; authorizing the Director of City Planning and Development to execute an agreement governing the use of subgrant funds; waiving applicant’s local match requirement; appropriating replacement local match funds and designating requisitioning authority.

Andrew Bracker, City Planning and Development, gave the staff report on the Ordinance. This Ordinance approved an application by Negro Leagues Baseball Museum, Inc. (NLBM) for a subgrant of $96,000 of federal brownfield grant funds for abatement of lead-based paint, additional asbestos and other hazardous waste contaminants from the Paseo YMCA Building, 1824 Paseo Boulevard, Kansas City, Missouri. The federal grant funds are part of a total of $3,000,108.00 awarded to the City by the U.S. Environmental Protection Agency (USEPA) to capitalize the Kansas City Brownfield Revolving Loan Fund. These grants were accepted by Comm. Sub. For Ord. No. 001210, and Ord. Nos. 070894, 100138, 120849, 140732, and 160539. The Ordinance also authorizes the Director of City Planning and Development to enter into a subgrant agreement with NLBM. The City is authorized by federal cooperative agreement no. BF-97700901 to loan a portion of its federal award to eligible governmental and non-profit entities. EPA has confirmed NLBM as an eligible recipient of RLF funds, and has determined the property to be eligible under the grant. The subgrant agreement will incorporate all applicable terms and conditions of the federal cooperative agreement and will be reviewed and approved by EPA prior to execution.

Ashley Winchell, City Planning and Development, gave the staff report on the Ordinance. The applicant proposed changing the use of Lot 5 from retail/restaurant to a gas station and convenience store. Lot 5 is teardrop shaped and is surrounded by right-of-way on all three sides. To the east of the site is Highway 150, to the south is W 138th Terrace, and to the north and west is Madison Avenue. The current State Line Station – Unit 3 development plan shows the side developed with a 10,500 square foot retail/restaurant and surrounded by surface parking.

Ashley Winchell, City Planning and Development, gave the staff report on the Ordinance. The applicant is requesting approval of a development plan in lieu of a special use permit to allow for the expansion of the existing Yamaha dealership. The dealership is classified as “Light equipment sales/rental (outdoor)” which requires a Special Use Permit by the Zoning and Development Code. Section 88-517-09 allows for approval of a Development Plan in lieu of Special Use Permit. The applicant chose this option so the area plan amendment, rezoning and site layout may be approved through one process. The existing showroom/office building is a single story structure with an open plaza surrounding the front. The building is stucco with a stone base. The existing storage building is located to the east of the showroom building. The existing storage building is a single story and metal. The storage building is not very visible from Holmes. The proposed storage building will be similar is scale, materials and size to the existing. The proposed storage building will be located to the east of the existing and is not expected to be visible from Holmes. The building is proposed to be 10,800 square feet. The roof of the building will slope to the east. There will be a garage door on the south side and additional entrances on the east side. Pavement will be extended to the new building. The easternmost portion of the site is undevelopable due to the grade and proximity to the Blue River. The applicant does not anticipate any further development to the east of this building. The development plan does not propose removing any trees from the site.

The alley ends at the property line of Gashland Elementary. Barry Road runs to the north of the alley. Directly north of the alley is Gashland Baptist Church. The church also owns two parcels south of the alley.

Olofu Agbaji, City Planning and Development, gave the staff report on the Ordinance. The applicant is requesting to change the zoning on the 17-acre tract of land. The Sports Complex Area Plan recommends Residential land use designation for this property. The proposed R-80 zoning is consistent with the Residential land use designation. This will be a downzoning of the area. The proposed rezoning will allow the applicant to live in the residence, establish a commercial stable and utilize the accessory buildings. The R-80 district also offers more flexibility and allows for rural agricultural uses that are otherwise prohibited in the R-7.5 zoning district. Staff recommends that the applicant combine the parcels into one lot.

Olofu Agbaji, City Planning and Development, gave the staff report on the Ordinance. The historic Pickwick Building was located on the east side of McGee Street between E. 9th Street and E. 10th Street, with frontage on Oak Street. The 2 acre parcel is a combination of 4 tracts of land. The parcel is developed with an apartment building. The main structure is 11 stories above ground and 2 stories below ground. The following is an excerpt from the applicant's proposed Signage Plan. "The Pickwick Plaza complex is a multi-tenant building for the purposes of signage count and size limitations of the Zoning Ordinance. The complex is on the National Historic Register and historic features are reviewed and approved by the National Park Service in order to obtain Tax Credits."

Chairman Taylor briefly highlighted the changes that were made since the last time the score card was discussed. The Committee reviewed the scorecard including the changes mentioned by Chairman Taylor. Topics highlighted were: ~Prevailing wages on Site based projects (increasing the points from 10 to 15) Chairman Taylor informed the public that public testimony would be taken today, the Ordinance would then be held for further discussion and consideration next week.
