Travis Kiefer, Public Works, explained that the ordinance represented the routine release and the directive to record 2 utility easement located in Kansas City, MO, Jackson County. There was no further tesitomy.

Approving the plat of The Condominiums of 513 Campbell, an addition in Kansas City, Jackson County, Missouri; and accepting various easements.

Travis Kiefer, Public Works, testified about The condo's at 513 Campbell, there are 3 residential condos in an existing building. The ordinance simply changes the for rent apartment to condos for sale. Frank/Phillip Marsalla are the owners and occupy the building.

Approving the plat of Fountain Hills-First Plat, an addition in Kansas City, Platte and Clay County, Missouri; accepting various easements; establishing grades on public ways; authorizing the Director of Public Works to execute certain agreements; and authorizing the City Clerk to file this ordinance and attached agreements.

Travis Kiefer, Public Works, stated that ordinance 040917 and 040918 or related to the plat of Fountain Hills 1st and 2nd plat. The plat will consist of 68 single family lots on approximately 37 acres of land near NW 92nd Terrace. The plan calls for 1 storm water detention. The developer agreed to maintian the storm water detention. Dave Matthews, John Lutgen, is the representative for the applicant. He stated that his client agreed with staff recommendation and requested advancement.

Travis Kiefer, Public Works, said that the ordinance dealt with the plat of Barry Pointe 9th. Rosie IV is the developer for the project. They are represented by Dave Matthews, John Lutgen. Councilman Fairfield ask who would occupy the commericial space? Dave responded that the proposed occupent is KFC.

Travis Kiefer, Public Works. testified regarding the Benson Place Woodchase 1st plat. The project consist of 45 single family lots on 1 tract Dave Matthews, John Lutgen and Associates, was present and represents T. Midwest Real Estate, the developer. The ordinance was substituted to correct the county designation for Clay County to Jackson County.

Amending Chapter 80, Code of Ordinances, by repealing Section 80-213, Conditional uses permitted for unlimited time, and enacting in lieu thereof one section of like number and subject matter, which adds a provision that would allow doctors offices to be included with nursing home conditional uses under certain conditions.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS AS A COMMITTEE SUBSTITUTE"
Virginia Walsh, City Planning, explained that this ordinance would assist in defining the conditional use of permits. It would allow doctors employed by nursing homes to run an office/clinic within the nursing home. Elaine McIntyre, Kansas City, Hospice Nursing Home, explained that the facility in question was only 1500 square ft. and served only the patients that reside in the nursing home. Councilwomen Cooper, asked would this action allow national chains to run a doctors offices in nursing homes/assisted living facilty. Elaine McIntyre stated that it was not the intent of KC Hospice to hire a national chain or to serve anyone outside the facility residents. There was decision regarding a comprise removing condition "C" . Councilman Nash, suggested holding the ordinance for one week so that the agent and staff could work through the details. Dave Franshier, the agent for the developer stated that he would prefer not to hold the item but advance it will the changes/ condition that staff recommends. Virginia Walsh, added that she thought that the issue with national chains taking advantage or monopolizing the market of caring for the elderly would be curbed by the fact that each case would have to be decided on a case by case basis and the committe would have discretion. Maggie Moran, Law Department, suggested language change. Mayor Barnes, commented briefly about the ordinance and the concerns. The ordinance was substituted and advanced.

RESOLUTION - Approving an amendment to the Downtown Land Use and Development Plan by amending the Proposed Land Use Plan and Map for a tract of land generally bounded by 13th Street on the north, 14th Street on the south, Grand Boulevard on the east, and Main Street on the west from residential/mixed use, open space and retail mixed use to office mixed use and retail mixed use.
