PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Edgar Jordan, Property Relocation, testified regarding the sale of property in the Richard Gebauer (Belton, MO) area. He stated that it is the intent of the City to sale/ transfer ownership of that property. The City of Belton has been leasing and maintaining the property for sometime and had been positioning itself to fully take over that property. The have all of the property except a 200 acre parcel.

Approving the preliminary plat of Sunset Building on an approximately .28 acre tract of land located at 4821 Roanoke Parkway. (SD 1106)

Jennifer Thomas, City Planning, testified about the preliminary platting of the Sunset Building located at 4821 Roanoke Parkway. The building is prominently located in the junction of the Plaza and Westport. The unit will be renovated and sold. Each units range in size from 750 sq - 969 sq ft. Dave Matthew, John Lutgen, agent for the developer was present.

Approving the preliminary plat of Churchill Building on an approximately .60 acre tract of land generally located at 803 W. 48th Street. (SD 1107)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Jennifer Thomas, City Planning, reviewed the condominium conversion for the Churchhill Building at 803 W. 48th St.The Churchhill is a 12 story building with apartment units ranging in size from 713-1146 sq ft. The building has 65 parking spaces which means that it is 4 short parking spots. There was discussion in the difference in the number of parking spaces listed on the plan vs. what is listed on the ordinance. Dave Matthews, John Lutgen, explained that a variance was given regarding the shortage of spaces.

Amending Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, by repealing Appendix A, Section 2.1, GP-1 General industry, and enacting in lieu thereof one new section of like number and subject matter to allow recreation centers, gymnasiums and athletic clubs.

Vince Huestead, City Planning, explained that the zoning change would allow a change in the GP-1 to include gyms, recreational centers and Athletic clubs. The GP-1 is generally thought to be for industrial use or its accessories but the change would include the addition of gyms etc. Dave Matthews, John Lutgen, was present.

Approving an amendment to a previously approved Community Unit Project on an approximately 28.67 acre tract of land generally located along both sides of N.E. 94th Street, west of N. Oak Trafficway. (12009-CUP-12)

Vince Huestead, City Planning, explained the Community Unit Project generally located at NE 94th St. near N. Oak Trafficway. The project adds 192 Multi-family and 136 townhomes. Councilman Fairfield asked about the stormwater detention. Dave Matthews said that the detention is still apart of the plan but has not been built yet.

Rezoning an area of approximately .13 acres generally located on the south side of E. 71st Terrace, approximately 150 feet west of Troost Avenue from District R-2a to District C-2. (12046-P-2)

Larry Stice City Planning, said that ordinances 040844 an 040845 involves the expansion of the soil/garden center. Rezoning from R-2a to C-2 with condition. There was and issue with the single family home that sits close to the soil/garden center. Brian Linch, Manager of the Soil Center. He stated that he had spoken with the homeowners and they have made an agreement to construct a 4 ft privacy fence with chain link top for safety and security purposes.

Amending the General Development and Land Use Plan, Kansas City International Airport, as amended, by changing the land use designation from District GP-2 to District GP-3 for an approximately 5.8 acre tract of land generally located on the west side of N. Green Hills Road approximately 1,200 feet north of N.W. Barry Road. (247-S-90)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Larry Stice, City Planning, explained that ordinance 040855 and 040856 are companions and relate to the land use plan near NW Barry Road and N Green Hills Road. The plan would allow the extension of the barrier between the commercial property and the residential property, would be 50ft with burning and trees hiding the lighting and the building from the residents. The traffic study recommended that an access road with a left and right turn. Councilman Fairfield stated that he had concerns about the access road and the left and right turn. He had spoken with the neighborhood association and the developer and believed that a comprise is possible. Patricia Jensen, White Goss, added, part of the comprise was a decrease in the square footage of the project which also help to unify the plan and extend the barrier.

He stated that all the various easements and grades had been checked and found acceptable by the Public Works Department. There were no known opponents to the project. PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS AS SECOND COMMITTEE SUBSTITUTE"
Councilwoman Becky Nace, testified that she had worked with the neighborhood association and the developer affected by the CUP near Bannister Road and Mo. HWY 350. There had been concerns regarding the type of access road to be use within the project, whither to gate the road and who would be responsible for maintence and signage, fencing and property set-back. After much discussion it was decided that the developer would add signage that would alert the public of the limited access/emergency nature of the road . The homes association would be responsible for the maintaince and the City would determine when the road and gate would be erected. The main issue with the road was that the proposed road was not adequate for emergency access. Larry Stice, City Planning, stated that staff recommended a gated and paved emergency access road but would support the chip and seal road with gate. Daniel Bowes, President of the Homes Association was present and stated that he was in support of the ordinance with the added conditions. Shawn Stewart, Lathrop and Gage,? expressed concern about the conditions and felt that the interest of his client had not been fully considered. Councilman Nash said that it felt that adequate time and discussion had been allowed and called for a vote.
