RESOLUTION - Approving an amendment to the Greater Downtown Area Plan for approximately an area of less than one acre generally located at the southeast corner of E. 21st Street and Troost Avenue and Missouri Route 71 (1119 E. 21st Street) by changing the recommended land use from Downtown Residential to Industrial. (675-S-1)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "BE ADOPTED"
City Planning and Development addressed the Committee. The existing subject parcel is 38.93 ft x 85 ft or about 0.1 acre. The site is located on the east side of newly constructed Troost Avenue at E 21st Street. At this location, Troost Avenue crosses over MO RTE 71 or Bruce R Watkins Roadway. The lot is on the south side of E 21st Street and at the west end, where E 21st Street dead ends at Troost Avenue. Since Troost Avenue extends over MO RTE 71 at this point, the pavement of the Troost roadway is higher in elevation by about 20 feet than the subject site adjacent to and east of the pavement. This lot is one of several generally vacant lots which are a remnant assemblage of lots bordered by E 21st, Troost, Forest Avenue and E 22nd Street. This one acre area is comprised generally of volunteer trees, shrubs, a small MODOT landscaped area and an outdoor storage facility.

City Planning and Development addressed the Committee. The total site is about 25 acres which is broken into two separate areas based upon zones and usage. The north portion is about 17 acres and is the site of a salvage yard. This northern portion site is zoned M 1-5. The south side is about 8 acres, is vacant and is the zoned R-7.5. The 17 acre site was annexed into the City of Kansas City, Missouri from unincorporated Jackson County in 1957. The salvage yard was an existing use within Jackson County at the time of annexation and was allowed to continue as such within Kansas City. The applicant received a certificate on legal non-conforming use (CLNU) in 1974.

City Planning and Development addressed the Committee. The applicant is requesting rezoning of the property to allow for its potential residential use. The current M3 zoning prohibits all residential uses, on the principle that they are incompatible with the intense industrial uses permitted by the district. The requested M1-5 zoning allows single-family homes as special uses, and permits by right residential uses on upper floors of commercial buildings and single-purpose residential buildings (building conversions to wholly residential use).

City Planning and Development addressed the Committee. This ordinance would take monies collected on behalf of the Union Hill SBD in 2012 and move them to an account so that they can be paid to the district. The UHSBD was established by Ordinance No. 900675 on December 6, 1990. The revenues generated within the UHSBD are for insuring, maintaining and operating the pedestrian lighting fixtures and brick entry monuments within the UHSBD.
