RESOLUTION - Approving an amendment to the Sports Complex Area Plan by changing the recommended land use on about 18.3 acres from commercial (neighborhood shopping) to residential medium density generally located on the east side of Blue Ridge Cut-Off and north of the Chicago, Rock Island, Pacific Railroad tracks. (101-S-9).

Olofu Agbaji, City Planning and Development, testified on behalf of this resolution and related ordinances, 080783, and 080784, and answered questions from the committee. Shawn Stewart,Stewart Law Firm , represented the applicant, testified and answered questions from the committee. Chris Cline, SWS Development LLC, was available to answer questions from the committee. Mike Morris, prioject architect, answered question about the building siding materials. Bruce Jones, Automatic Systems Inc., expressed concerns about the noise and light from his business to the south of the proposed development. He requested that a 15 foot concrete wall be placed between his business and the development to block the noise and light. This was his only concern regarding the development. Ron Daye, Show Me Audio-Visual, testified in opposition to the proposed development and asked that the land be kept for commercial development as stated in the original area plan. This resolution and companion ordinances will allow for 260 multi-family residential units in 13 buildings and one clubhouse and an open space tract. The committee decided to hold this for two weeks.

Patty Noll, City Planning and Development, explained the purpose of this ordinance and companion ordinance, 080770, and answered questions from the committee. Scott Schulte, Patti Banks Associates, summarized the major components of the stream setback ordinance. Patricia Jensen, representing KC Deed, supported the ordinances and requested that the effective date be changed to six months. This ordnance and the companion ordinance will require new development to maintain a buffer to a stream and through a provision of a density bonus and reduction in lot size and setback requirements, encourages conservation development.
