Brian Pitts,City Planning stated the this ordinance would amend the text of the Zoning Ordinance to change the filing deadline for an appeal of the decision of the Codes Administrator in issue/not issue a certificate of Legal nonperformance. This is a effort to provide consistency in the appeal process, Staff suggested a unified filing deadline on the fifteen day from the date of any decision or public notice from the Codes Administrator. Councilman Nash asked what is the intend of the ordinance. Brian responded, in short the ordinance will help streamline the process of creating or converting existing structures into condominiums and townhouses etc.

PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Virginia Walsh, City Planning, stated that the ordinance would allow an extension to the area plan, increasing the number of single family homes and allowing rezoning from RA to R-1BB and improvements to the parkway. Each single family lot will be an average of 90-110 ft. Some opponents to the project are citizens of the City of Gladstone. The opponents are concerned with the distance the project from the parkway and the lack of an adequate barrier between their property and the new project. Councilman Nash stated that issues like these should really be addressed in the preliminary platting stage. The developer Kevin Kazer, indicated that he thought that adequate notice, negotiation and concession had been given for the concerned parties and he would like to move forward with the project. He believed that because the homes being built were above average homes, with and asking price of 300-500k with clubhouse and pool available the project would be and asset to the area. He added that he had the support of the school district, had extend the sewer lines and created a treed buffer over and above the requirement of the City. He asked that the project be allowed to move forward. The Committee agreed and advanced the ordinances 040850 and 040851 as a substitute.

Approving the plat of Tiffany Woods at Rose Creek, an addition in Kansas City, Platte County, Missouri; accepting various easements; establishing grades on public ways; authorizing the Director of Public Works to execute a certain agreement; authorizing the Director of Aviation to execute a certain agreement; and authorizing the City Clerk to file this ordinance and attached agreements.

Travis Kiefer, Public Works, indicated that the ordinance pertain to the plat of Tiffany Woods at Rose Creek. The project will consist of 72 single family lots. The grades, easement and right of way have been checked and have been found to be acceptable. Dave Palvich, Aylett Fowlers and Associates was present and acting as the agent for the applicant. He corrected the named of the applicant to be TSGD not TSDG as indicated earlier.

Approving the plat of Southmoreland Condominiums, an addition in Kansas City, Jackson County, Missouri; and accepting various easements.

Travis Kiefer, Public Works, stated that this ordinance was for the plat of Southmoreland Condominiums. He explained that the project is a three story brick building with 2 condominium units per floor for a total of 6 condominium units. The units are located on the northwest corner of 44th st and Walnut. This ordinance is a legislative procedure required by the City Charter after the plat has been approved by the City Plan Commission and the grades and closure have been checked and approved by the Engineering Division of Public Works Department. A request for variance to the rear yard setback is required for the proposed Quicktrip store. No opponents are known to the project. Staff recommends approval.

Condemning and taking permanent and temporary storm drainage easements on private property for the construction of a storm sewer improvement for the properties of Plateau Park II, located between 5933 N.W. Hutson and 3406 N.W. 59th Terrace, all in Kansas City, Platte County, Missouri .

Edgar Jordan, City Planning, said that the ordinance was for the purpose of condemning and taking permanent storm sewer easements and temporary construction easements on private property for the construction and maintenance of storm sewers associated with project number 3737; 5933 NW Hutson, located in Kansas City, Platte County, Mo. This a sales tax storm sewer project which was originated by citizens request. The PIAC recommended the project in 2003 and the project was subsequently approved. Permanent and temporary easements are necessary on 4 properties for this project. Easements on 2 of the properties have been acquired. This ordinance will authorize condemnation of easements over 2 properties.

Larry Stice, City Planning, explained that ordinance was a routine vacation an access/utility easement in Wedgewood Pointe 3rd plat. The plat is near the northwest quadrant of Bannister Road and Missouri HWY 350. The ordinance would allow development of single family residential lots. Shawn Stewart, Stewart Law Firm is the agent for the applicant.

Accepting the recommendations of the Tax Increment Financing Commission as to the Second Amendment to the Barry Towne Tax Increment Financing Plan; approving the Second Amendment to the Barry Towne Tax Increment Financing Plan.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "DO PASS"
Manish Patel, TIF, indicated that this ordinance was the first step in amending a TIF. If approved the ordinance would provide for the change in the land use for project area VII and other administrative changes. The TIF revenue generated within the redevelopment area would continue to be used only for public infrastructure improvements. The intent of the TIF remains unchanged except in the respect that is would change the land use for this portion of the project from multi-family to mixed use, multi-family, retail and office. That change is similar to the use of other projects in the area. There are no known opponents to the project.
 
 There will be a Closed Session to discuss a Real Estate Transaction pursuant to RSMO. 610.021 (2).
