Troy Schulte, Budget Office, testified on behalf of the ordinance. This ordinance would reconcile encumbrances from FY00-01 that were inadvertently liquidated from the KCATA Operations account.

Establishing the KCMAC Series 2004A-Bartle Hall Expansion Fund, KCMAC Series 2004B-Prospect North Fund, KCMAC Series 2004B-Tow Lot Fund, KCMAC Series 2004B-Bartle Hall Expansion Taxable Bonds Fund, 2004B-Bartle Hall Expansion Tax Exempt Fund and KCMAC Series 2005A- Bartle Hall Refunding Series 1995A Fund; estimating revenues in the amount of $80,885,000.00, $2,405,000.00, $755,000.00, $850,001.00, $6,411,041.00, $20,610,000.00 in KCMAC Series 2004A-Bartle Hall Expansion Fund, KCMAC Series 2004B-Prospect North Fund, KCMAC Series 2004B-Tow Lot Fund, KCMAC Series 2004B-Bartle Hall Expansion Taxable Fund, KCMAC 2004B-Bartle Hall Expansion Tax-Exempt Fund and KCMAC Series 2005A-Bartle Hall Refunding Series 1995A Fund, respectively; and appropriating same to the appropriate accounts; appropriating debt service payments for fiscal year 2004-05; designating requisitioning authorities; and authorizing the Director of Finance to close project accounts upon completion.

This ordinance will estimate and appropriate bond proceeds from the sale of Kansas City Municipal Assistance Corporation Bonds. It will also reimburse the City from bond proceeds for certain expenditures incurred, appropriate debt service payments for fiscal year 2004-05 and designate requisitioning authorities.

Approving the issuance of Variable Rate Demand Tax-Exempt Revenue Bonds (Kansas City Downtown Redevelopment District) Series 2004, by the Industrial Development Authority of the City of Kansas City, Missouri, in an aggregate principal amount not to exceed $140,000,000.00, in one or more series, to provide funds to finance certain redevelopment project costs; and authorizing and approving certain documents and actions in connection with the issuance of such bonds.

Amending Chapter 34, Code of Ordinances, by repealing Article XII, Smoking in public places, consisting of Sections 34-471 through 34-479 and enacting in lieu thereof a new Article XII entitled “Prohibitions on smoking in enclosed places of employment and public places”, consisting of Sections 34-471 through 34-481, prohibiting smoking in enclosed places of employment and enclosed public places and establishing penalties for noncompliance.

Heather Brown, Law Department, and Galen Beaufort, City Attorney, reviewed the changes that were made to this ordinance. Dr. Rex Archer, Health Department, Olivia Williams, City of Kansas City employee, asked to include a distance from the entrances of buildings for smokers to be at when smoking. Bobby Baker, Bobby Baker's Lounge, opposes ordinance. Shante Bradford, server at the Majestic Steakhouse, opposes ordinance. Charles Fairchild, attorney for the Missouri Resturant Association, entered a Position Statement he created on request from the Association. Mr. Fairchild also included several written testimony from various restuarant employees. Handout is on file in the City Clerk's Office. Robert Norton, Isle of Capri Casino, oposses the ordinance. Rita Mooby, Antionettes Lounge, asked if private clubs would be included? Councilman Eddy explained that if they had employees they would have to comply. Jan Allen, Missy B's, opposses the ordinance. Donald Potts, Health Commission, had questions regarding some of the changes made to the ordinance.

Providing for submission to the qualified voters of the City for their approval at an election called for Tuesday, February 8, 2005, the question of increasing the ad valorem tax levy for capital improvements and operating expenses for hospital and public health purposes from fifty cents ($.50) to seventy-two cents ($.72) per one hundred dollars ($100.00) assessed valuation on real and tangible personal property within the City; directing the City Clerk to notify the responsible election authorities of this election; and recognizing this ordinance to be an emergency measure.
