Authorizing the condemnation and taking of private property in fee simple for public use for Storm Water Project No. 82000148, Storm Drainage Improvements, Eastern Avenue to Old Santa Fe Road, in the vicinity of 9030 Eastern Ave between Old Santa Fe Road and Loma Vista Drive, in Kansas City, Jackson County, Missouri; providing for the payment of just compensation therefore; authorizing continued negotiations and purchase by the Director of the Public Works Department; authorizing the filing of the petition for condemnation by the City Attorney on behalf of the City; and directing the City Clerk to record this ordinance in the Office of the Recorder of Deeds for Jackson County.

Andy Shively, Water Services Department, gave the staff report on the Ordinance. This ordinance is pursuant to the provisions of Chapter 523 of the Revised Statutes of Missouri, 1994, as supplemented or amended by Section 86.01 to 86.10 of the Rules of Civil Procedure. The property being condemned for public use shall be used by Kansas City for said construction and improvements therein including any necessary appurtenances , or structures to it; and Kansas City shall have the right to enter in or authorize the entry in and upon for the purpose of constructing, and maintaining said facility.

Authorizing a $175,500.00 amendment with Custom Engineering, Inc., for the Birmingham Pump Station Mid-Range Pumps Project; authorizing a maximum expenditure of $175,500.00; and recognizing this ordinance as having an accelerated effective date.

Andy Shively, Water Services Department, gave the staff report on the Ordinance. The Birmingham Wastewater Pump Station was originally built in the mid 1970's. The station was equipped with 4 centrifugal pumping units: two sized to pump 4,900 GPM (gallons per minute), and two sized to pump 22,200 GPM each. Two pumps are operated with constant speed motors and two pumps are operated with variable speed motors. In 2001, two additional dry-pit submersible type mid-range pumping units were installed, each capable of pumping 12,500 GPM and operated with variable speed motors. Peak flows into the plant can be as high as 30 to 35 MGD (millions of gallons per day).   The original four pumping units have reached the end of their service life and are no longer functional. Under this project, two of the original four pumping units will be replaced with two new mid-range pumping units to increase reliability of the pump station and reduce the risk of wet weather overflows.   The Birmingham Wastewater Pump Station receives influent flow from four sources: the 120-inch Shoal Creek Interceptor, the 20-inch Liberty Force Main, the 48-inch North Bank Interceptor, and the 27-inch Birmingham Interceptor. The influent flow is pumped to the Birmingham Wastewater Treatment Plant. During heavy rainfall events, excessive influent flows caused by inflow and infiltration sources cannot be pumped to the Birmingham Wastewater Treatment Plant due to inadequate pumping capacity, and resulting in overflows from the collection system.

This project is associated with the Federal Consent Decree regarding the City of Kansas City, Missouri Overflow Control Plan. This project is being completed to improve the performance and reliability of the combine sewer collection system and reduce the occurrence of basement backups by repairing structural defects and eliminating sources of inflow and infiltration in the collection system

The project will improve the performance and reliability of the City's combined sewer system and help reduce the occurrence of basement backups by repairing structural defects and eliminating sources of inflow and infiltration in the collection system project area.
