Tom Coyle, City Planning and Development, introduced Patty Noll, City Planning and Development, and Kirk Bishop, Ducan Assiociates, who developed the code update. Ms. Noll commented on the development code and turned the floor over to public testimony. Patricia Jensen, White Goss Law Firm, represented KC Deed, a group of developers and Chris Byrd, Christopher W. Byrd PC, presented issues to the overall adoption of a new development code. The following voiced their support of the new development code and also concerns about certain parts of the new code and its implementation: Tim Underwood Brenner Holland Ora Reynolds Vicki Noteis Eric Rogers Laurie Chipman Stan Masters Jim Bowers This ordinance will be held for an additional two weeks.

Approving an amendment to a previously approved development plan in District URD on approximately 2.42 acres generally located on 46th Street between Jefferson and Summit Street.


PLANNING AND ZONING COMMITTEE recommends "DO PASS"
John Eckhardt, City Planning and Development, testified on behalf of this ordinance and companion ordinance, 081029, and answered questions from the committee. Aaron March, White Goss Law Firm, and Don McKenzie, 46 Summit Association, testified regarding the development and the dedication of additional right-of-way for 46th Street and answered questions from the committee. Dave Miniger, Douglas & Associates, answered questions regarding the traffic study. Alexis Petri, Plaza-Westport Neighborhood Association, voiced her concerns about widening 46th Street. This ordinance and companion ordinance, 081029, will allow for the tax abated construction of a 12-story hotel and an 8-9 story senior living facility with a total of 214 units.
