RESOLUTION - Approving and endorsing Cheyenne 940, LLC, in its application to the Missouri Department of Economic Development for state remediation tax credits for redevelopment of 1215 West 12th Street, Kansas City, Missouri.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "IMMEDIATE ADOPTION"
Andrew Bracker, City Planning and Development, provided the presentation for this ordinance. This ordinance approves and endorses Cheyenne 940, LLC, in its application to the Missouri Department of Economic Development for state remediation tax credits for redevelopment of 1215 West 12th Street, Kansas City, Missouri. State Law requires an applicant to obtain City endorsement for the remediation tax credits. This resolution is the endorsement needed for the application. The applicant is seeking state remediation tax credits to pay for up to approximately $821,920 in remediation of lead-based paint, asbestos and metals contaminants in surface soils for commercial property located at 1215 W. 12th Street, Kansas City, Missouri.

Approving the establishment and adoption of a two-year pilot program authorizing 20 years of 100% real property tax abatement for qualified Enhanced Enterprise Zone (“EEZ”) development projects, which are also located within designated Opportunity Zones and the East Side Investment Zone.

Drew Solomon, Economic Development Corporation (EDC) presented this ordinance. This ordinance approves the establishment and adoption of a two-year pilot program authorizing 20 years of 100% real property tax abatement for qualified Enhanced Enterprise Zone (“EEZ”) development projects, which are also located within designated Opportunity Zones and the East Side Investment Zone. This ordinance allows for development to be directed to the more distressed areas of the city which will enable growth and increase economic mobility. The goal is to invest in a dense ecosystem of nearby businesses, properties, and residences with the potential to transform a neighborhood in a way that benefits residents of that community. Gerald Williams and John Debauche, City Planning and Development, provided the presentation for this resolution. This resolution approves an update to the Greater Downtown Area Plan as a guide for the future development and redevelopment and public investment within the area generally bounded by the city limits of North Kansas City on the north, the state line on the west, 31st Street on the south, and Woodland Avenue on the east; and repealing and replacing the Greater Downtown Area Plan approved in 2010. The presentation included: the area plan, process timeline, public engagement overview, plan overview, land use and development, transportation plans and Streetscape Corridors information. This ordinance amends Chapter 88, Zoning and Development Code, through revisions, clarifications, and other administrative changes throughout the chapter in accordance with the Zoning and Development Code periodic review. This ordinance makes 4 revisions: correct spelling, include an item pertaining to short term rental applications, specifically list “data center” as a typical use and to allow structured parking under certain conditions. Olofu Agbaji, City Planning, provided the presentation for this ordinance. This ordinance rezones approximately 376.86 acre tract of land located along N.W. 132nd Street between N. Winan Avenue and N. Mexico City Avenue from Districts M2-3 and B3-3 to AG-R. This purpose of this ordinance and the companion ordinance 190568 is to expand the Stamper Quarry Development plan in order to allow a rock quarry, rock crushing and an asphalt plant. Patricia Jensen, Routs, Frets, White, Goss Law Firm, representing the applicant, advised that this area is located off the airport runways, therefore, there are limited uses for airport operations. This ordinance approves the preliminary plat for Franklin Heights in District R-6 on about 0.368 acres generally located at the southeast corner of W. 21st Street and Belleview Avenue to create four residential lots. This ordinance proposes 4 deviations to the following: to the minimum lot, minimum lot widths, minimum front yards and minimum side streets. Christ Hughley, City Planning and Development and Patricia Jensen, Routs, Frets, White, Goss Law Firm, provided the presentation for this ordinance. This ordinance rezones approximately 123.5 acres of land generally located at the northeast and northwest corners of N. Eastern Avenue and N.E. Cookingham Drive from District R-80 to District MPD, and approving a preliminary MPD plan to allow for construction of 217 single family homes, 104 townhome units, 200 multi-family units, community pools and clubhouses, a day care facility, retail space, and a convenience store with fuel pumps. This ordinance removes the proposed townhomes and replaces them with single family products and adds one additional big house for a total of 527 dwellings. The applicant agrees with all conditions. During this meeting it was suggested by Councilwoman Shields to remove the dog park which was agreed upon with the applicant. Ms. Jensen advised that phase 1 will begin with single family homes, phase 6 is the big homes concept, the small commercial space is phase 7 and the convenient store is phase 8. There was testimony from the public for this ordinance, speakers card are on electronic file in the City Clerk’s office.
