Condemning and taking private property for flood protection improvements, for the purpose of construction, reconstruction, maintenance, operation, patrol, and repair of flood protection improvements, recreational and related purposes and any and all appurtenances incidental thereto in, under, along, upon, over and through that reach of the Blue River known as Byram’s Ford Industrial Park; providing for the payment of just compensation thereof; and authorizing negotiations by the Director of City Development and the Director of Water Services, all in Kansas City, Jackson County, Missouri.

Authorizing the Director of Public Works to execute a construction manager at risk (CM@Risk) contract with M.A. Mortenson Company for the downtown arena project that includes Phase 1 Preconstruction Services in the amount of $390,000.00 and Phase 2 Construction Services in the amount of the total direct construction costs plus the CM@Risk’s general condition fee of $6,301,458.00 and the CM@Risk’s fee of 2.25% of the direct construction costs; authorizing the Director of Public Works to exercise the City’s option for Phase 2 construction services upon the City Council’s appropriation of funds from bond proceeds; finding it is in the best interests of the City to utilize the modified MBE/WBE solicitation procedures and requirements set forth in the CM@Risk contract documents and authorizing their use pursuant to section 38-91, Code of Ordinances.

Rich Noll, City Manager's Office, explained the purpose of the ordinance. He detailed the responsibilities of the contract manager at risk and answered questions from the committee. Mr. Noll distributed "Preliminary Procurement Strategy And Community Participation Plan" prepared by M. A. Mortenson Company and gave a summary of the plan. Mike Burke, representing M. A. Mortenson Company, testified regarding use of local labor. Larry Kemp, Greater Kansas City Building and Construction Trades Council, stated that M. A. Mortenson announced that it has made public a commitment for those crafts it will use and it will execute collective bargaining agreements. Those agreements have not been executed at this time but it was relayed to him that upon award of the contract that this would happen. That has been their public commitment to the trades. He thank the committee for its diligence.

 Staff from the City Auditor's Office will present an audit on "Arena Construction Manager Selection." Mark Funkhouser, City Auditor's Office, distributed the report to the committee. Mr. Funkhouser went through the report and explained the objectives, scope and methodology, and background of the report. Mr. Funkhouser also explained the findings and recommendations in detail and answered questions from the committee. Councilwoman Nace and Councilman Riley commented on the audit and the selection process. Bobby Hernandez, 2121 Jarboe, Kansas City, Missouri testified regarding minority participation in the bidding/selection proccess. He emphasized the need for minority participation in awarding contracts to contractors on the project. Consideration of the Semi-Annual Docket items.
