RESOLUTION - Approving and endorsing Commerce Tower Group, LLC, in its application to the Missouri Department of Economic Development’s Brownfields Redevelopment Program, as authorized by, and in accordance with Sections 447.700 through 447.718 of the Revised Statutes of Missouri, for state remediation tax credits for redevelopment of 911 Main St., Kansas City, Missouri.

Andrew Bracker, City Planning and Development, gave the staff report on the Ordinance. Resolution endorses Commerce Tower Group, LLC (“Applicant”) in its application for state remediation tax credits. State law requires applicant to obtain City endorsement. Applicant seeks approximately state remediation tax credits to pay for $7,000,000 in abatement of lead-based paint and asbestos from currently vacant and underutilized floors within the Commerce Tower building located at 1111 Grand Blvd., Kansas City, Missouri 64108. At a public meeting held July 29, 2014, the Kansas City Brownfields Commission considered the Applicant’s project and adopted resolution 004-2014 (a copy of which is attached hereto) recommending that the application be endorsed by the City Council, subject to the condition that the project be enrolled into the Missouri Department of Natural Resources, Brownfields Voluntary Cleanup Program, and that condition has now been met. Under state law, an applicant may be issued as many remediation tax credits as it is eligible to receive. The issuance of tax credits to Applicant will not reduce the opportunity of any other project or individual in Kansas City, Missouri to seek and be issued remediation tax credits. Nor will the endorsement of Applicant or the issuance of remediation tax credits to Applicant result in any financial responsibility or obligation upon the City.

Councilman Wagner gave a brief introduction to the Ordinance. He then turned the floor over to Claude Page, City Planning and Development Department. Ordinance 110423 established the CID Revolving Loan Fund for the purpose of creating a fund to assist with the establishment of commercial improvement districts in business corridors within distressed areas of the City. Initial funding was $80,000; the City has contracted with the Northeast Chamber of Commerce and the Southtown Foundation for establishment of new CIDs. Those funds have now been repaid to the Fund. $68,000 currently exists in the fund balance, which did not roll over with the change in fiscal year. An additional $12,000 has been repaid in fiscal year 2015. This ordinance will estimate and appropriate the FY 2015 repayment. The ordinance will also appropriate the unappropriated fund balance rolled forward from the prior fiscal year. This ordinance will allow the funds to be used for assistance for additional CIDs to be established.

The property owner has been cited several times for zoning violations and would like to avoid future citations by changing the existing zoning on portions of the parcel.

This request is accompanied by a rezoning request (Companion Case No. 14483-P, Ordinance No. 140663). The purpose of it is to rezone the subject property from R-1.5 to B3-2 consistent with the property to the east along Prospect (much of the Prospect corridor is zoned B3). The applicant has indicated that the rezoning is necessary to create additional site area for the construction of a retail store at the southeast corner of E 30th and Prospect. The controlling plan is the Heart of the City Area Plan which recommends low-density residential uses for the subject property; consequently, the companion rezoning request requires approval of an amendment to this area plan to change the land use designation from Residential, Low-Density to Mixed Use Community.
