Authorizing condemnation and taking of private property located at 9251 Hillcrest Road, Kansas City, Missouri in fee simple for public use for reclamation of blighted, substandard or insanitary area within the Bannister & I-435 TIF Redevelopment Area; receiving evidence, and making a determination, that this property is blighted, substandard or insanitary; providing for the payment of just compensation therefore; authorizing continued negotiations by the Public Works Department; consenting to the filing of the petition for condemnation by the City Attorney on behalf of the City; and authorizing the City Clerk to cause this ordinance to be recorded in the office of the Recorder of Deeds for Jackson County, Missouri.

Austin Steelman, Law Department, gave a brief overview of the Ordinance. 9251 Hillcrest Road is situated within the Redevelopment Area of both the original Bannister & I-435 Tax Increment Financing Plan and the First Amendment to the Bannister & I-435 Tax Increment Financing Plan. The City Council has previously considered whether the area within which 9251 Hillcrest Road is situated is blighted, substandard or insanitary. First, in relation to the Council’s consideration of Committee Substitute for Ordinance No. 130737, which the Council passed on October 10, 2013. Second, in relation to the Council’s consideration of Ordinance No. 140594, which the Council passed on August 14, 2014. 9251 Hillcrest was the former site of a Circuit City store that has now been vacant for a number of years. The City has sent an offer letter to the owner. The offer was based on an appraisal. The offer was rejected.

Approving the Petition to establish the Main Street Community Improvement District, Inc.; establishing the Main Street Community Improvement, Inc., generally bounded by 27th Street on the north, Emanuel Cleaver II Boulevard on the south, both east and west side of Main Street with easterly extensions on Linwood Boulevard, 39th Street and 43rd Street, and westerly extensions near 31st Street, 38th Street, 39th Street and J.C. Nichols Parkway in Kansas City, Jackson County Missouri; and directing the City clerk to report the creation of the District to the Missouri Department of Economic Development.

The petitioner, Jesus Name Pentecostal Church, owns all of the parcels that would gain property from this vacation. The vacation of the unbuilt street in this request will prevent the future development of NE 53rd Street and will not affect traffic circulation or access availability to citizens within the block or Kansas City as a whole.

The request to rezone the site to MPD (Master Planned Development) is accompanied by a preliminary development plan. Projects would be constructed during four phases over the next 11 years and include a community center, adult daycare center, worship center, and future single family homes. The development plan also serves as a preliminary plat, and portrays vacation of the north/south alley extending from E. 27th Street to E. 28th Street, mid-block between Wabash and Prospect Avenues.

The subject site is a vacant, platted industrial zoned parcel. The development will consist of two 3-story buildings with a maximum height of 37 feet. Building 1 (15 units) has a total of 33 spaces are required for the residential units. The proposed development meets the requirement of the Zoning and Development Code as it relates to parking.

Councilwoman Curls gave a brief overview of the Ordinance. Sarah Baxter, Law Department, gave a brief staff report on the Ordinance. Property located at 3818 Garfield was acquired by Ivanhome from the Land Bank of Kansas City, Missouri. It is just one tract of several included in the plat. The property previously went through the delinquent property tax sale. The title insurer has made an exception to title for a 2002 Deed of Trust that is unreleased of record. A quiet title action or some other type of action may be needed to obtain a release of such deed of trust. Ivanhome and Ivanhoe Neighborhood Council have agreed to enter into a Covenant to Perform to commence and pursue such quiet title, if needed. Efforts have been made to locate the stated beneficiary, or lender, which is Gannett Capital, which has failed to register with the Missouri Secretary of State, or the Wyoming Secretary of State, which is the lender’s address. The Land Bank is providing assistance for a demand upon alternative, possible addresses.

Chairman Ford reminded the Committee that the plan was to have multiple public hearings offering plenty of options for persons wanting to testify. He reminded the Committee that this is the third week of public testimony. There will be at least one more week of public testimony, afterwhich the Committee could vote on the issue.

 1. There may be a discussion regarding the Departmental Strategic Objectives relating to the Planning, Zoning, and Economic Development goal in the Citywide Business Plan.
 
 2. TSE Consulting will discuss their “ Analysis of Business Plan for the Kemper Arena Project.
 
 Dale Neuburger, TSE Consulting, addressed the Committee. The objectives of the project were to review submitted business plan nd supporting documentation to determin if assumptions are viablea nd realistic, market analysis of indoor facilities utilized for youth sports and competitive events, and a business analysis to dtermine growth opportunities if any beyond what is presentated in the proposal. Mr. Neuburger discussed the findings on the deliverables as tasked.
 
 3. There may be a discussion regarding the future of Kemper Arena.
 
 4. There may be discussion of Council Priorities relating to economic development.
 
 5. There may be general discussion regarding current Planning, Zoning and Economic Development issues.
 
 6. Pursuant to the following subsections of Section 610.021 of the Revised Statutes of Missouri, there may be a closed session to discuss: (1) legal matters, litigation, or privileged communications with attorneys, pursuant to subsection 1; (2) real estate, pursuant to subsection 2; (3) personnel, pursuant to subsection 3 and 13; and/or (4) sealed bids or proposals, pursuant to subsection 12
