John Eckardt, City Planning and Development, gave the staff report on this Ordinance. The proposed plan calls for 8 out-parcels in addition to the Sam’s Club parcel. These include a bank, three restaurants and four fast food pad sites. The pad sites range in size from 4,000 sf to 8,000 sf. There will be four access drives from recently constructed NW Skyview Avenue with two being right-in, right-out only and two being fully accessed. There are two right-in, right-out drives on N Ambassador Drive. There is one right-in, right-out access drive from NW Tiffany Springs Road. All right-in, right-out drives are required because of the existing medians within the roadways. The out parcels and shops ring the remainder of the triangular shaped parcel around the Sam’s Club. Parking for the project generally extends through the site from west to east in front of the anchor and out-parcel tenants. In total, there are 716 parking spaces required and 1,099 parking spaces provided. Also identified on the plan is 38,465 sf of interior green space required within the parking lots and 48,934 sf provided.

Ashley Winchell and Angela Ealy, City Planning and Development, gave the staff report on the Ordinance. The proposed overlay is more comprehensive than the existing Special Review Districts. The overall goal of the overlay is to require higher quality buildings designed to encourage pedestrian activity along Independence Ave. The standards require commercial buildings to be located at the property line and constructed of masonry on the ground level. Residential structures may be located up to 15 feet from the property line. The standards also require a specific number of building elements to encourage architectural interest along the corridor.

John Eckardt, City Planning and Development, gave the staff report on the Ordinance. The developer proposed to rezone the site to DX-7. The applicant stated that they will seek tax abatement through the Planned Industrial Expansion Authority (PIEA). Normally, the City Planning and Development Department through agreements with representatives of the EDC and PIEA and through the approved incentive plans, require the applicants for tax incentives to rezone developed property to District UR (Urban Redevelopment District). In some cases however, if the property is certified as “Historic” and if the property development is being reviewed by a federal agency associated with the Secretary of Interior Standards, City Development Department staff has waived the rezoning to District UR requirement. In addition, in this case, no appreciable site work is being requested as the parking will be contained within the site’s buildings. Also, the alleyways will be left intact and no vacation of the alleys is being requested. The applicant wants the ability to rehabilitate the site for residential use. According to Use Table 140-1, Household Living, whether in a single family home, a single-purpose residential building or in a mixed-use building is not allowed in the existing M 3-5 district.
