Amending Ordinance No. 050771 passed June 30, 2005, which authorized assessments on Sewer District Nos. 16003 and 16004, by repealing and reenacting Section 6 thereof to amend the list of assessed benefiting properties and clarify the assessment amount.

Authorizing a $411,231.00 Amendment No. 1 to an agreement with HDR Engineering Inc. for Project 89008148, NW 72nd Street Extension-Overland to Waukomis Drive; and authorizing the Director of Public Works to expend an additional $411,231.00 from previously appropriated funds.

Condemning and taking permanent and temporary easements on private properties for the construction and maintenance of sanitary sewers in the area of NE 38th Street and N. Brighton Avenue, in Kansas City, Clay County, Missouri; providing for the payment of just compensation therefore; authorizing continued negotiations by the Director of City Development; consenting to the filing of the petition for condemnation by the City Attorney, on behalf of the City; and authorizing the City Clerk to file this ordinance with the Recorder of Deeds in Clay County, Missouri.

Ted Anderson, Assistant City Attorney, stated that the ordinance allowed for the condemnation for 37 tracts for a project in Clay County, Missouri. The city has secured all but on tract and will continue to work on securing that tract.

Approving Traffic Regulation Numbers 59203 through 59270, 59272 through 59285 and 59287.

Greg Rokos, Public Works, stated that the traffic regulations associated with this ordinance had been published for over ninety days. The ordinance will make the regulations permanent.

Authorizing a $3,415,214.20 contract with J.M. Fahey Construction for the construction of the Freighthouse District Improvements; estimating revenues in the amount of $2,145,514.00; reducing and appropriating funds in several accounts in the Capital Improvements Fund; reducing and appropriating funds in several accounts in the Series 2004F G.O. Bond Funds; authorizing the City Manager to expend $4,349,336.00 for the project; designating requisitioning authority; and recognizing an emergency.

Authorizing the Director of Water Services to execute an Agreement with the Universal Land Development Co., L.P. and the Tax Increment Financing Commission of Kansas City, Missouri for financing, design and construction of stormwater controls in the Executive Park area; appropriating funds and authorizing the Director of Water Services to expend up to $850,000.00 for the project; directing the City Clerk to record this ordinance and agreement; and recognizing an emergency.

Jim Mellem, Water Services, stated that the ordinance authorized an agreement between Water Services and the developer. Dan Cofran was on hand to represent the developer and to answer any questions about the project.

Condemning and taking street and temporary right-of-way on private properties for the construction and maintenance of Red Bridge Road, between Holmes Road and Blue River Road, said properties all in Kansas City, Jackson County, Missouri, providing for the payment of just compensation therefore; authorizing continued negotiations by the City of Kansas City; consenting to the filing of the petition for condemnation by the City Attorney, on behalf of the City; and authorizing the City Clerk to file this ordinance with the Recorder of Deeds in Jackson County, Missouri.
