The request was to consider approval of a development plan on about 6 acres in District B3-2 (Community Business dash 2), to allow for a 60,000 square foot health and rehabilitation facility with 70 rooms (120 beds) and 80 parking spaces. Access to the site is proposed via two driveways on NE Parvin Road. The driveways will loop and connect in front of the building and provide a secondary service drive along the east side. The building is located in the middle of the site pushed to the south.

Olofu Agbaji, City Planning and Development, gave the staff report on the Ordinance. The applicant requested to rezone the KCU campus from Districts R-1.5, R-2.5, R-6, B1-1, B3-2 and B4-2, to District MPD (Master Planned Development), and approval of a preliminary development plan for an educational institution. The KCU campus has developed under the existing zoning designations over the years. The majority of the school/ campus uses are allowed by right as long as they meet the location requirements within residential districts. Given the wide variety of uses within the campus setting, including some amount of commercial use inherent in the campus life buildings and the proposed garage, it has become increasingly difficult to comply with all requirements of the various zoning districts. KCU has requested the rezoning to an MPD district to place the entire campus under a single MPD development plan. In MPD districts, the uses, height, density, setbacks and other components of zoning are established by the site plan. Procedurally, preliminary MPD plans are approved by the City Council following recommendation by the City Plan Commission. Final MPD development plans, for individual phases or even individual buildings, are approved by the City Plan Commission upon determine their conformance with the preliminary MPD plan.

Olofu Agbaji, City Planning and Development, gave the staff report on the Resolution. It was noted that this was a companion to Ordinance 170117. The Healing House was established to provide safe and stable homes, with opportunities for spiritual and personal growth, along with purposeful guidance and support, for men and women who are committed to overcoming their addiction and becoming responsible, productive, drug and alcohol free members of our community. The plan is to renovate the existing building and provide 4,200 square feet of assembly space, 3,800 square feet of office space and about 1,300 square feet of accessory use space. The plan shows 13 parking spaces on Lot 1 and 29 parking spaces on Lot 2 for a total of 42. Both parking spaces will be used by the Healing House. The Zoning and Development Code requires 72 parking spaces for the uses identified on the plan, but only 42 spaces are provided. The applicant is seeking a variance of 30 parking spaces. There is a parking analysis on the face of the plan that shows the limited parking use by this development. The applicant is also seeking a variance of 7 feet from the required 10 for vehicular use areas adjacent to residential zoned district.

Ashley Winchell, City Planning and Development, gave the staff report on the Ordinance. The plan does not propose any major changes to the site beyond amending the use from hotel to apartments. The plan does include reinstalling landscaping when needed and adding addition parking spaces to provide a 1:1 parking ratio. Once converted the site will have 112 residential units within 14 separate buildings. A total of 112 parking spaces will be provided – eight of which will be accessible parking spaces. The plan does not show required short- and long-term bicycle parking. The proposal requires 12 short-term bicycle parking requirements and 38 long-term spaces. The buildings will go through the required permitting process to change the occupancy. The plan does not propose changing the elevations or layout of the site.
