RESOLUTION - Approving an amendment to the Gashland Area Plan by amending the Proposed Land Use Plan and Map for an area of approximately 1.58 acres generally located at the southwest corner of N. Oak Trafficway and N.E. 79th Terrace, by changing the recommended land uses from "office commercial uses" to "retail commercial uses". (215-S-6)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "IMMEDIATE ADOPTION"
Resolution 010516 and ordinance 010517 are related cases. Brian Pitts, City Development stated that the resolution will amend the Gashland Area plan from Office Commercial to Retail Commercial and approve a development plan from R1a to District C2p. The Gashland Area Plan is bounded by Clay/Platte County line on the west and Gladstone city limits to the south. The plan also recommends office/commercial on the site. The developer is proposing to construct a 3,700 square foot convenient store, six gasoline pumps and car a wash. The property is located at NW Oak Trafficway and NE 79th Terrace. He gave a overview of the surrounding land use. The site consist of four lots with three residential structures. The residential sites are proposed for demolition. Staff feels that rezoning of the 2.52 acres to commercial would encroach too far into the residential neighborhood, therefore staff is recommending that the western section of the lots remain in District R1a and that the two zoning districts be platted as two individual lots. The developer has complied with all of the recommendations.

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0362, rezoning an area of approximately 1.58 acres generally located at the southwest corner of N. Oak Trafficway and N.E. 79th Terrace from District R-1a (One-Family Dwellings) to District C-2-p (Local Retail Business - Limited District), and approving a preliminary plan for the same. Lee Dixson, Public Works Department, testified on the ordinance. He stated that the plat is for a 2 lot subdivision on 19 acres in the vicinity of Unity Village. All of the grades and closures have been checked and recommended approval.

RESOLUTION - Reaffirming the Council´s policy to allocate 10-15% of annual City-wide Public Improvement Advisory Committee (PIAC) funds to Downtown capital needs as recommended by FOCUS Kansas City and directing the City Manager to communicate this policy reaffirmation to the Public Improvements Advisory Committee for its deliberations and recommendations.

Mayor Barnes spoke in favor of the resolution. She stated that the downtown area is the heart of the city, metropolitan area and the Kansas City region. The City has engaged in a variety of activities to make downtown the best it can be. Without capital improvements dollars the city would be much more limited in reaching the vision. Authorizing a contract amendment with the Housing and Economic Development Financial Corporation (HEDFC) decreasing the HOME funding for the Single-Family Homeownership Program by $1,700,000.00 and decreasing CDBG funding for Housing Development Program-non-CDC areas by $600,000.00; authorizing an Implementation Agreement Amendment with HEDFC and the Housing Authority of Kansas City, Missouri, decreasing the CDBG funds by $500,000.00 and providing $500,000.00 of HOME funds for the purpose of providing funds for public housing; authorizing a contract amendment with HEDFC for the Multi-Family Housing Program; and approving certain amendments to certain Consolidated Plans.

Lee Dixson, Public Works Department, stated that the plat is for 15 single family residences with private street. The developer was required by ordinance to improve the private street, to submit a storm drainage study, obtain a land disturbance permit and to do improvements to west 132nd Street. All of the grades and closures have been checked and recommended approval. Darren White, John Lutjen & Associates, applicant, recommended approval of the ordinance.

Approving and designating Redevelopment Project Area 2 of the KCI Corridor Tax Increment Financing Plan as a Redevelopment Project and adopting tax increment financing therein.

Laura Whitener, Economic Development Commission, stated that ordinances 990258 and 990260 deals with KCI Corridor Tax Increment Financing Plan. The plan was approved in March '99. The proposed plan is bounded by Tiffany Springs Parkway, Barry Road, I-29 and Skyview Road. The purpose of the plan and Tax Increment Financing (TIF) revenues are for the construction of road improvements the area The anticipated source of revenue is the construction of a Wal-Mart, Lowes and a Bank. Approval of the ordinance will allow collection of the TIF revenues from Lowes and the bank building. She noted that there are no PILOTS (payment in lieu of taxes) being used on the project but they're being distributed back to the taxing district. Committee recommended approval of both ordinances.

Ordinances 010474, 0101475 and 010476 are related cases. Don Gustafson, City Development, stated the location of the site is on the north side of NW 68th Street and N. Bell Ave. Ordinances 010474 and 010475 will rezone from district RA to District R-1a. The site is currently a wooded area. The preliminary plat will create 39 single family lots. The area plan supports the proposed R-1a and R-1b zoning. The southern portion of the development proposes 16 lots and are proposed to be zoned R-1b, requiring a minimum of 6,000 square feet of lot area. Ordinance 010476 will approve a preliminary plat which proposed 55 single family residential lots on 33 acres. The lot averages out to about 10,000 square feet. City Plan Commission and staff recommended approval. Councilwoman Cooper expressed concerns regarding the Line Creek Flood Plain. Lee Dixson, Public Works Department, answered Ms. Cooper's concerns. Nancy Burchell, 6814 N. Liberty, Kansas City, Missouri, requested that something be done in making sure the drainage is adequate in the area, Larry Thrasher, 1807 NW 63rd Street, spoke in reference to the erosion in the Line Creek area. Committee recommended to hold ordinances 010474, 010475 and 010476 until May 30, 2001.
