Authorizing the devotion of City owned property for public street purposes in connection with the 19th Street street construction project from Agnes Avenue west to Kansas Avenue, all in Kansas City, Jackson County, Missouri, and authorizing the city clerk to record this ordinance.

This ordinance would dedicate a portion of property in lots 41 and 42 which is needed as a right-of-way in the construction of 19th Street.

Authorizing a cooperative agreement between the cities of Kansas City, Missouri and Gladstone, Missouri for the construction of a walking/biking trail between Kansas City and Happy Rock Park in Gladstone.

Amending Chapter 62, Code of General Ordinances of Kansas City, Missouri, by repealing Sections 62-48, 62-49, 62-53, 62-54 and 62-55 and enacting in lieu thereof new Sections 62-48, 62-49 and 62-53, expanding prohibited practices to include refuse or recycling containers remaining on a curb or right of way for more than 24 hours and establishing penalties for violations of article I and II .

Approving a $2,590,000.00 contract with Landmark Structures I, L.P. for Contract No. 8150, Kansas City/Raymore Elevated Storage Tank; approving a $170,000.00 contract with Bucher, Willis & Ratliff Corporation for Contract No. 8198, Kansas City/Raymore Elevated Storage Tank Construction Phase Services; designating requisitioning authority; authorizing the Director of Water Services to expend $2,890,000.00 for the project; declaring the City’s official intent to reimburse from bond proceeds; authorizing the Director of Water Services to execute an amendment to the Water Purchase Agreement between the City of Kansas City and the City of Raymore; and authorizing the Director of Finance to return unexpended appropriations to the appropriate account.

Jim Mellum, Public Works Department, testified on behalf of this ordinance. This ordinance would allow the city to approve a contract for elevator storage and elevated storage for the Water Services Department. The projects include constructing a 2.5 million gallon composite-style elevated storage tank consisting of concrete support pedestal and welded steel bowl.

Authorizing the Director of Public Works to amend the construction manager at risk (CM@Risk) contract with M.A. Mortenson Company for the downtown arena project to restructure the scope of the General Construction Services into Phases 2A and 2B, increase the general conditions fee to reflect additional work and to include $14 million for the contract costs; authorizing the Director to amend the contract without City Council approval and recognizing an emergency.

Enacting a new Section 70-750, Code of Ordinances, entitled “Operation or riding of certain motor-driven cycles on streets and sidewalks unlawful” to prohibit operating any motor-driven cycle with 50 or less cubic centimeters displacement on any street, highway, sidewalk or other public property.

Lisa Young, Mother of Phillip Young (deceased), testified on behalf of this ordinance. Mrs. Young gave brief testimony how her sone died due to the pocket bikes. She is asking that the city ban these bikes on streets and private property so that no one else looses their life because of the bikes. Lees Summit and Raytown, Missouri have banned the bikes and this is the reason Phillip came here to the Kansas City area to ride. The committee searched for information to see if it was more necessary to ban the bikes because of the height of the size. Galen Beaufort, City Attorney, gave the committee the specs. on the bikes. A copy is on file in the City Clerk's Office, attached to the ordinance.
