Approving an amendment to a previously approved development plan in District URD (Urban Redevelopment District) on approximately a 321 acre tract of land generally bounded by Bannister Road on the north, I-435 and U.S. Highway 71 on the west, I-470 on the south, and the west boundary of the Mooreland/Hillcrest Heights Subdivision on the east, for the purpose of deleting an approximately 11.7 acre tract of land from said development plan. Ordinances 000384 and 000385 are companion cases. Virginia Walsh, City Development Department, stated that the ordinances involve property located on the east side of 71 Highway south of Bannister Road, known as the "Bannister Building Park". Ordinance 000384 will amend the Hickman Mills TIF plan by deleting 11.7 acres. The purpose of the ordinances is to remove 11.7 acres warehouses from the URD (Urban Redevelopment District) rezoning it back to its original zoning C-3a1-p (Intermediate Business, Low Building - Limited District) to allow for the construction of warehouses for about 32,000 square feet of additional mini storage space within two buildings. Staff and City Plan Commission recommended approval.

Oak Trafficway and south of N.E. 85th Terrace from Districts R-1a (One-Family Dwellings), C-3a1 (Intermediate Business, Low Buildings) and C-3a1-p (Intermediate Business, Low Buildings - Limited District) to District C-3a1-p (Intermediate Business, Low Buildings - Limited District), and approving a preliminary plan for the same. Ordinances 000386 and 000388 are companion cases. David Lane, City Development Department, stated that the ordinances consist of an area south of NE 85th Terrace west of N. Oak Trafficway. Ordinance 000386 is to consider a request to rezone 2.57 acres rezoning from R1a (One Family Dwellings), C3a1 to allow construction of mini storage warehouse units. On May 5, 1998 the City Plan Commission recommended approval of the plan. Approval of the ordinance would add 1900 square feet of mini warehouses to the site. Ordinance 000388 will rezone the site to C3a1 (Intermediate Business, Low Buildings), staff believes that the zoning is appropriate due to the limited size of the area. The area is currently being used as a parking lot. Committee recommended approval. Councilman Ford expressed how important it is to maintain the tree line on 85th Terrace.

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0275, rezoning an area of approximately 4.6 acres generally located on the west side of West Longview Parkway, approximately 700 feet south of 107th Street, from District GPA (Agricultural) to District GPR-1 (Residential, Low Density), and approving a development plan for the same. David Lane, City Development Department, stated the ordinance will rezone 4.6 acres located on the west side of West Longview Parkway, south of 107th Street. The purpose of the rezoning is to allow construction of six single family residential lots. Staff and City Plan Commission recommended approval with certain conditions.

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0279, rezoning an area of approximately 7 acres generally located south of 77th Street between Holmes Road and Campbell Street from District R-5-p (High Apartments - Limited District) to District R-5 (High Apartments).

Ordinances 000411 and 000412 are companion cases. David Lane, City Development Department, stated that the city was approached by the attorney's of current owners to have a deed of restriction that was placed on the overall site. Within the deed of restrictions it was stated that no buildings may be permitted to be constructed within 150 feet of any property line and that the site is to be used as senior's apartment units and a skilled nursing facility geriatric center. The owners have an interest to sell the property, potential buyers have indicated an interest to have the deed of restriction lifted which is automatically renewed every twenty-one years. Discussions with the parties (Attorney, City Development staff and City Attorney's) concluded the best way to handle this is to develop a plan district containing R4 and R5 zoning. Ordinance 000411 will rezone seven acres located south of 77th Street between Holmes and Campbell. Ordinance 000412 will rezone 15 acres located south of 77th street. In order for the plan district to occur the applicant has submitted a site plan, showing the existing construction on site. City Plan Commission recommended approval of the project. A committee substitute was submitted for ordinance 000412. Ralph Bellar, Attorney, concurred with staff's recommendations. Committee recommended approval of the ordinance.

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0280, rezoning an area of approximately 15 acres generally located south of 77th Street between Holmes Road and Campbell Street from Districts R-4 (Low Apartments) and R-5 (High Apartments) to District PD/R-4, R-5 (Planned District/Low Apartments, High Apartments); approving a development plan for the same; and authorizing the execution of a Termination Agreement with Shalom Plaza, Inc. and Shalom Geriatric Center, Inc. for the termination of certain deeds of restriction.

PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Ordinances 000329 and 000330 are companion cases. Dan Cofran, Attorney, representing the applicant, stated that since last week's meeting he was able to meet with Councilmen Brooks and Eddy to discuss ideas regarding a cooperative agreement for the project for intersection improvements at View High Dr. and Meers Road. He also stated that they were supportive of the project. Mr. Cofran requested that the ordinance be amended, provide that the city and developer enter into a cooperative agreement so that developer would contribute and pay the city over 70,000.00 (one-third of the total cost) for funding of the intersection improvements at Meers Road and View High Dr. Lee Dixson, Public Works Department expressed concerns regarding the $71,000.00. He's not comfortable with whether the Missouri Department of Transportation will participate in the cost of the intersection and is not sure of their requirements. He also stated that there is no mechanism for the state to enter into an agreement. Therefore the agreement can only be between the city and developer in hope that the state will participate. It was agreed upon by the committee that condition #15 be amended stating that the developer shall contribute and pay to the city a sum equal to 1/3 of the cost (but in any event not less than $71,333.00 or more than $85,000.00 of the improving the intersection of View High Drive and Meers. Road. A committee substitute was submitted for ordinance 000330.

Ordinances 000351 and 000352 are companion cases. Virginia Walsh, City Development, stated the purpose of the ordinance is to rezone approximately 361 acres and to approve a Community Unit Project. Approval of the ordinance will allow development of 801 single family lots, private open space including a swimming pool and clubhouse. The site is currently undeveloped. The site lies north of N.E. Staley Road, which the proposed Shoal Creek Parkway will include section of NE Staley Road. A committee substitute was submitted on ordinance 000352. City Plan Commission and staff recommended approval. Jim Bower, attorney (representing the applicant), spoke in support of the project. Jim Bliss, Superintendent, North Kansas City School District, expressed his concerns regarding the project. He informed the committee on how the rezoning would affect the school district as far as over crowding. The committee was also informed that the area residents were in opposition of the project because of lot sizes and too much traffic.
