Amending Chapter 10, Code of Ordinances, by repealing Section 10-212, Distances from churches or schools, and enacting in lieu thereof a new article of like number and subject matter which adds exemptions p and q.


PUBLIC SAFETY AND NEIGHBORHOODS COMMITTEE recommends "DO PASS"
Mr. Renner, explained that the ordinance would allow for a wavier for two churches that are within the 300 feet requirement of distance between churches and establishment serving alcoholic beverages. The two churches have submitted letters of supports.

Amending Chapter 48, Nuisances, and Chapter 56, Property Maintenance Code, of the Code of Ordinances, by repealing Sections 48-77 and 56-291, and enacting in lieu thereof new sections of like number and subject matter.

This item was held for one week the committee thought that more discussion and clarification was needed regarding the procedures for the Hearing Officer and if the officer should be a licensed attorney.

Amending Chapter 10, Code of Ordinances, by repealing Section 10-105, General requirements for temporary and annual catering permits, and enacting in lieu a new section of like number and subject matter which further defines a temporary catered event and adds additional criteria.

Gary Majors, Regulated Industrities, testified that this ordinance was in an attempt to close a loop hole allowing person who did not qualify for liquor licenses to run a baR under a "temporary catered event license"

Amending Chapter 10, Code of Ordinances, by repealing section 10-211, Number of retail alcoholic beverage licenses, and enacting in lieu thereof a new article of like number and subject matter which under 10-211(1)(c)(iii) adds an exception to allow for an additional sales-by-drink license.

Estimating revenue in the amount of $232,000.00 and appropriating it in the Police Grants Fund for the Forensic Backlog Reduction Program 08 and designating requisitioning authority.

Daryl Woodward,Police Department, explained that the ordinance would allow for the purchase of equipment to help reduce the back log of DNA cases and improve case management.

Authorizing acceptance of a Missouri Department of Health and Senior Services grant in the amount of $116,628.00; estimating revenue and appropriating the sum of $116,628.00 to the 07 MDHSS-Community and Nutrition Assistance-After School At Risk Program account in the General Fund; and authorizing a catering contract in the amount of $97,800.00 with the Kansas City Missouri School District.

Jackie Powell, Neighborhood and Community Services, explained that the ordinance would allow for a catering cooperative agreement with the Kansas City, Missouri School District, food services department. The service will be given to at risk child and adults within a geographic area where at least 50% of the children qualify for free or reduced meals.

Calling for submission to the voters of Kansas City, at a special election to be held Tuesday, April 8, 2008 a question amending Chapter 34, Code of Ordinances, by repealing Article XII, Smoking prohibited in enclosed places of employment and public places, consisting of Sections 34-471 through 34-481 and enacting in lieu thereof a new Article XII entitled "Prohibitions on smoking in enclosed places of employment, public places and public sidewalks abutting acute care hospital property lines," consisting of Sections 34-471 through 34-480, prohibiting smoking in enclosed places of employment, enclosed public places, including the Truman Sports Complex, and public sidewalks abutting acute care hospital property lines; establishing penalties for noncompliance; authorizing and directing the City Clerk to notify the responsible election authorities of this election; and recognizing an emergency.


PUBLIC SAFETY AND NEIGHBORHOODS COMMITTEE recommends "ADVANCE AND DO PASS AS A COMMITTEE SUBSTITUTE, DEBATE"
Public testimony was taken. A list of names and comment cards are on file in the City Clerk's Office. There was discussion from the committee regarding two separate proposed substitutes with the following changes: the percentage from 50% to 75%, changing sections 34-473 (6) (10), exception to include casino floors, cigar shops, concourses at staduims, areas near hospitals and the ballot language.

 Consideration of semi-annual docket. All items were release except 061246 which was held for one week. There may be general discussion of Public Safety and Neighborhood Committee issues.
