There is an unapproved "rite-of-way" (commonly known as "paper streets") of Belmont Ave and extends to the South and extending behind homes. This ordinance amends the Briarcliff-Winwood Area Plan, by changing the recommended land use on about 2.696 acres of land generally located on the east side of N.E. Vivion Road between N.E. 54th Street to the south and E. Park Avenue to the north from Mixed-Use Neighborhood to Mixed-Use Community. RESOLUTION - Approving an application to the United States Environmental Protection Agency for a Brownfields Assessment Coalition Grant in the amount of $600,000.00; authorizing the City of Kansas City, Missouri to enter into a coalition with the Mid-America Regional Council, Jackson County, Missouri, and, the Unified Government of Wyandotte County/Kansas City, Kansas and to submit the Grant; authorizing the Mayor to submit a letter accompanying the Grant application expressing the City’s intent to enter into the coalition; and authorizing the Director of City Planning and Development to enter into a Memorandum of Agreement with Coalition members.

Andrew Bracker, City Planning and Development, gave a presentation on this ordinance. The City will not be the applicant on this project due to the grant eligibility rules as there are excess unspent funds on the already existing coalition grant. The grant is due January 31st and announcements will be made in late Spring (May or June) timeframe. This ordinance approves an application to the United States Environmental Protection Agency for a Brownfields Assessment Coalition Grant in the amount of $600,000.00. It authorizes the City of Kansas City, Missouri to enter into a coalition with the Mid-America Regional Council, Jackson County, Missouri, and, the Unified Government of Wyandotte County/Kansas City, Kansas in order to submit the Grant. This grant authorizes the Mayor to submit a letter accompanying the Grant application expressing the City’s intent to enter into the coalition. It will also authorize the Director of City Planning and Development to enter into a Memorandum of Agreement with Coalition members.

Olofu Agbaji, City Planning and Development, provided the presentation on this ordinance. This service center will service Parkhill school district and will be about 70,000 square feet. The transportation hub will be about 22,000 square feet and the parking for the drivers will be for 175 buses. The parking will be screened from public view. This ordinance approves a development plan in District M2-3 on about 40 acres generally located on the west side of N. Congress Avenue in between N.W. 97th Terrace to the north and N.W. Rezoning a 2.696 acre tract of land generally located on the east side of N.E. Vivion Road between N.E. 54th Street to the south and E. Park Avenue to the north from Districts B1-1 and R-6 to District B3-1 to allow for the construction of a commercial building and allow outdoor retail sales. (6962-P-4, 6962-P-5)

Justin Peterson, City Planning and Development, gave the presentation on this ordinance. There is an unapproved "rite-of-way" (commonly known as "paper streets") of Belmont Ave and extends to the South and extending behind homes. A regulated stream bisects the property. The property is currently 3 properties and the applicant is in the process of platting to create 2 properties. The rezoning would allow for outdoor retail sales and the construction of a 6,500 feet retail building up towards N.E. Vivion. Outdoor items for sale would be palletized landscape materials, nursery stock, bulk landscape materials. A forklift and a skidsteers would be on site for loading and unloading. Hours of operation would be 7am - 5:30 pm Monday thru Friday and Saturday for peak seasons. A retaining wall is proposed along the eastern portion of the site which will range in height. A chain link fence would surround the rear of the property and a decorative rod iron would surround the front of the property. The applicant is expecting that the existing vegetation will be removed upon approval of this ordinance removing the original modification of removal for the condition. Primary access to the site will be from N.E. Vivion Rd but the applicant is proposing to use the existing Belmont "rite-away". David Schatz, Spencer Fane Britt & Browne, also provided further information on this ordinance. David stated that the retaining wall would be in regards to the matured vegetation. The retaining wall will be 30 ft. in from the property line and most of the trees would be on the neighborhood side in regards to matured vegetation. Deb Herman, Northland Neighborhoods Association, provided public testimony opposed to this ordinance and the related ordinance (190033). Scott Wagner, 1st District Councilman, provided public testimony opposed to this ordinance and the related ordinance. Mark Stock, resident of related neighborhood, provided public testimony opposed to this ordinance and the related ordinance. Mr. Stock also provided handouts related to the opposition of this ordinance. Colton Stock, resident, provided public testimony in opposition of this ordinance and the related ordinance. This ordinance rezones a 2.696 acre tract of land generally located on the east side of N.E. Vivion Road between N.E. 54th Street to the south and E. Park Avenue to the north from Districts B1-1 and R-6 to District B3-1 to allow for the construction of a commercial building and allow outdoor retail sales. Authorizing the removal of the condition imposed in Ordinance No. 180710 that required the removal of a billboard as a part of the transfer of City owned property to the Land Clearance Redevelopment Authority of Kansas City, Missouri, generally located in the northeast quadrant of the intersection south of Highway 40 and north of Interstate 70, to facilitate redevelopment within the Blue Valley Urban Renewal Area; and directing the City Clerk to record this ordinance.

 1. Staff from the City Auditor’s Office, City Planning, and Water Services departments will present an ARTS report for the Timeliness of Land Development Plan Reviews Could Be Improved audit.
 
 2. There may be general discussion regarding current Planning, Zoning and Economic Development issues.
