Approving the petition to establish the State Line Shopping Center Community Improvement District; establishing the State Line Shopping Center Community Improvement generally located on the east side of State Line Road south of 100th Street and north of 103rd Street, in Jackson County, Kansas City, Missouri; determining the State Line Shopping Center Community Improvement District to be a blighted area; determining that certain actions are reasonably anticipated to remediate blighting conditions and will serve a public purpose; requiring the annual submission of certain records; and directing the City Clerk to report the creation of the State Line Shopping Center Community Improvement District to the Missouri Department of Economic Development.

Amending a previously approved Chapter 80 preliminary development plan in Districts R-1a (One-family dwelling district – medium density (46.72 acres)) (now R-7.5) and R-5 (High apartment district (9.33 acres)) (now R-0.5) generally located south and east of N.E. Shoal Creek Drive, west of Interstate 435 and north of N.E. Pleasant Valley Road, to allow for minor modifications to the plan which will allow for 140 residential units and two institutional uses. Diane Binckley, City Planning and Development, gave the staff report on the Ordinance. This CUP Plan is divided up into proposed phases or sections. They include, from north to south -- The North Phase, Central Phase, Southwest Phase and Southeast Phase. The application states that only the Southeast Phase is being changed. The Southeast Phase is located south of the Temple, west of I-435 and west of an open space tract, east of a large 6-plus acre open space tract for park purposes and north of NE Pleasant Valley Road and also north of a private open space tract for stormwater detention. The Southeast Phase is 12.49 acres which includes proposed street right of way and private open space. This area is approved for maximum number of 41 single family detached units. Two public roadways were approved though the Southeast Phase, NE 70th Street and N Cambridge Avenue. The entire Southeast Phase is sandwiched in between two open space tracts. With the two proposed public roads, there is a limited amount of lot depth remaining for construction.

Olofu Agbaji, City Planning and Development, gave the staff report on the Ordinance. The applicant is requesting to change the zoning on the 20-acre tract of land. The Line Creek Valley Area Plan adopted by Resolution No. 110030 on February 10, 2011 recommends Residential High Density land use designation for this property. This land use designation allows up to 29 units per acre. The proposed R-1.5 zoning is consistent with the Residential High Density land use designation. The 20 acre parcel with the current R-2.5 zoning will yield 217.8 lots or 348.5 units per acre. The same 20 acres with the proposed R-1.5 zoning will yield 290.4 lots or 580.8 units per acre. This is a difference of 72.6 lots or 232.3 units for the 20 acres. With the increase in density on the southern 20 acres, staff recommends that N. Granby Avenue be connected to NW 85th Terrace to provide the necessary connection for public safety. Because this is a rezoning without a plan, staff recommends a condition that any proposed development on this parcel be required to submit a development plan to the City Council to ensure that N. Granby properly connects to NW 85th Terrace. Staff also recommends that N. Granby Avenue be improved to a two-lane road with a median to the limit of the parcel to be rezoned at such time as the parcel is developed.

Diane Binckley City Planning and Development, gave the staff report on the Ordinance. It was noted this is a companion to Ordinance 160461. The site is currently under construction with a 5-unit townhome. Preliminary and final plats were approved for the construction of this unit in the summer of 2015. The units were to be split through a condo plat and the building was to be surrounded by a common lot. The developer wishes to sell the units as 5 individual lots. This requires waivers to the lot and building standards and that a new final plat is recorded.

The ordinance requests the authorization to execute an Agreement with respect to an issuance of bonds by the IDA of Platte County Missouri to refund the Series 2007 Bonds. The Agreement retains the same requirements of the City as with the Series 2007 Bonds and therefore represents no change to the City's position in this transaction.

Travis Kieffer, Parks and Recreation, gave the staff report on the Ordinance. The Board adopted the new Boulevard and Parkway Standards on June 16, 2015 in accordance with their duties outlined in Chapter 53 of the City’s Code of Ordinances. The new standards were adopted as part of the City’s development code through the Second Committee Substitute for Ordinance 150544 on July 23, 2015. This is the first time the land use portion of the standards had been adopted by ordinance making them an enforceable part of the City’s development code. Since the adoption of the standards by ordinance, staff has been working on revisions to the MSP to reflect the content of the new standards.
