Authorizing the Director of Water Services to execute Amendment No 2 to an Amended and Restated Agreement for Construction of Certain Water Improvements Pursuant to the Universal Floodwater Detention Tax Increment Financing Plan Agreement with the Tax Increment Financing Commission of Kansas City, Missouri; and recognizing this ordinance as having an accelerated effective date.

Andy Shively, Chief Engineering Officer, Water Services, testified that The City Council approved Committee Substitute for Ordinance No. 101014 on December 16, 2010 approving execution of an $11,252,500.00 agreement between the Tax Increment Financing Commission of Kansas City, Missouri and the City of Kansas City, Missouri, through its Department of Water Services, for the construction of certain storm water improvements as provided for by the Universal Floodwater Detention Tax Increment Financing Plan. The original term was to end on March 1, 2014. A no-cost Amendment No. 1 was executed by the City in April 2014 extending the term to September 2, 2015. Amendment No. 2 is required to extend the term to February 1, 2016. There is no cost associated with this ordinance.

Authorizing condemnation and taking of private property interest for public use as Permanent Waterline Easements and Temporary Construction Easements along N.E. 54th Street, from N. Oak Trafficway to N. Walnut Street and along N.W. Englewood Court east of N. Broadway Avenue for a water improvement project “Arrowhead Transmission Main-Phase 3”, Project No. 80001652, in Kansas City, Clay County, Missouri and the City of Gladstone, Clay County, Missouri; providing for the payment of just compensation therefore; authorizing continued negotiations and purchase by the Department of Water Services; authorizing the filing of the petition for condemnation by the City Attorney on behalf of the City; and directing the City Clerk to record this ordinance in the office of the Recorder of Deeds for Clay County, Missouri.

Andy Shively, Chief Engineering Officer, Water Services, Andy Shively, Chief Engineering Officer, Water Services, requested authorization for the condemnation and taking of private property for public use is required for this project because negotiations with the property owners have not been successful despite efforts over several months. The route for the water transmission main was determined to be the most feasible and no reasonable alternatives exist that obviate the need for the required easements.

Andy Shively, Chief Engineering Officer, Water Services, testified that they intend to construct a new gate structure to store up to 20 million gallons of wastewater in the existing 17 ft. high x 18 ft. wide double box culvert, located at approximately 2301 State Line Road in Kansas City, Missouri. This project affects City Council District 4, in Jackson County, Missouri.

Authorizing a Design Professional Services contract with EmNet, LLC for the In-Line Storage and Conveyance Operational Analyses Project; authorizing a maximum expenditure of $630,000.00; and recognizing this ordinance as having an accelerated effective date.

Andy Shively, Chief Engineering Officer, Water Services, testified that Engineering services are required to determine the return on investment (ROI) for utilizing a RT-DSS for the express objectives of combined sewer overflow (CSO) and sanitary sewer overflow (SSO) reduction, increasing the effective capacity of the existing collection system, and balancing of flows to utilize available capacity at the Line Creek and Buckeye Pumping Stations and the Westside, Blue River, and Birmingham Wastewater Treatment Plants. If RT-DSS is determined to be feasible, it may be used to reduce the size of future capital projects outlined in the Consent Decree.

Authorizing a Design Professional Services contract for approximately $596,000.00 with HNTB Corporation for a 36-Inch Water Transmission Main Extension from N.E. Vivion Road and N. Chouteau Trafficway, north along N. Chouteau Trafficway, to Big Shoal Greenway, east to N. Brighton Avenue near N.E. 55th Street; and recognizing this ordinance as having an accelerated effective date.

Andy Shively, Chief Engineering Officer, Water Services, testified that this contract is for an on-call indefinite quantity design professional services contract. The scope of services includes surveying, drafting, hydraulic modeling, estimates of construction costs, right-of-way acquisition, construction management, construction inspection and design of stormwater improvements including culverts, storm sewers, inlets, drainage ditches, improving channels, sustainable "green" best management practices, or other improvements necessary to improve or maintain the stormwater conveyance system.

Amending Chapter 76, Vehicles for Hire, by revising five sections pertaining to the definition of a taximeter, qualifications of a vehicle permit, qualifications of an applicant, rates, and use of a taximeter to more clearly define and better regulate the industry and take out requirements of a written and oral exam to coincide with all other sections of the ordinance.

Authorizing the Director of Public Works to execute a $1,250,000.00 Funding Agreement with the Tax Increment Financing Commission for improvements to Shoal Creek Parkway from N. Holly Avenue to Platte Purchase Drive; authorizing for improvements to Shoal Creek Parkway the expenditure of the remaining $594,457.21 previously appropriated and allocated by Ordinance 140292; authorizing the Director of Public Works to enter into a Reimbursement Prioritization Agreement with the Tax Increment Financing Commission and Hunt Midwest Real Estate Development, Inc. for the prioritization of Tax Increment Financing funds for the Old Tiffany Springs Road Bridge over I-29; waiving the requirement of Section 68-446(d)(2) of the City’s Code of Ordinances  for  the public improvements advisory committee to make a recommendation to the City Council; and recognizing this ordinance as having an accelerated effective date.
