Estimating revenue of $587,316.00 and appropriating $612,000.00 into the Governmental Grant Fund; and accepting and approving a $612,000.00 grant award amendment from the U.S. Department of Justice, to provide funding to the Aim4Peace Program; and designating requisitioning authority.


NEIGHBORHOODS AND PUBLIC SAFETY COMMITTEE recommends "ADVANCE AND DO PASS, DEBATE"
Rashid Junaid, and LoToya Jones, Health Department, testified that this ordinance authorizes the Director of Health to accept a grant from the U.S. Department of Justice, Office of Juvenile Justice and Delinquency Prevention in the amount of $612,000.00. These funds support Aim4Peace violence prevention initiatives in Kansas City, MO.

Amending Chapter 10, Code of Ordinances, by repealing Sections 10-1, 10-3, 10-101, 10-103, 10-113, 10-117, 10-118, 10-119, 10-120, 10-121, 10-122, 10-123, 10-124, 10-125, 10-126, 10-127, 10-134, 10-136, 10-185, 10-211, 10-214 and 10-332 and enacting in lieu thereof new sections to comply with Missouri State Statutes that eliminate liquor licenses and permits that are no longer in effect and create a new license and fee adjustments for out of state manufacturers.

Jim Ready, Regulated Industries, did not testify on this ordinance, and it will be held in committee for one week, January 18, 2017. Alcoholic beverages are no longer classified by alcohol content by the State of Missouri. One of the main reasons for this is because beer and malt beverages are no longer being made with an alcohol content at or below 5% as it now varies widely due to the large number microbreweries that have come into existence throughout the United States, and the rest of the world. Due to this, the definition of malt beverages and intoxicating liquor have been changed under Missouri State Statute and in Kansas City, ordinances will be defined based on ingredients. A license for nonintoxicating beer is no longer offered from the State of Missouri. Therefore, all nonintoxicating beer licenses and references to nonintoxicating beer have been eliminated. The definition of malt liquor has been changed to malt beverages to match the language as provided in Missouri State Statutes.

Calling an election on April 4, 2017, for the purpose of establishing a maximum $25.00 fine for the possession of 35 grams or less of marijuana, eliminating the possibility of jail for the possession of marijuana, and removing marijuana from the prohibition against paraphernalia; enacting the new provisions contingent upon voter approval; directing the City Clerk to provide notice of the election; and recognizing an accelerated effective date.

Cecilia Abbott, City Attorney and Jeffrey Carey, Carey & Carey Law Firm, gave testimony of this committee substitute for the purpose of establishing a maximum fine of $25.00 for possession of marijuana and possibly eliminating jail time for the possession of, and removing from the prohibition.

Be prepared to leave your Driver`s License or State issued Identification Card with the secretary and she will give you the equipment. Upon returning the equipment your license will be returned.
