Authorizing the Director of Finance to accept the proposal of Banc of America Public Capital Corp (“BAPCC”) to provide funds for the acquisition, installation and construction of various real property, capital equipment and other personal property; to approve Lease Counsel; and to execute any and all documents and agreements necessary for the transactions under one or more master lease purchase agreements.


FINANCE, GOVERNANCE AND PUBLIC SAFETY COMMITTEE recommends "DO PASS"
A committee, of The Finance Department staff, was formed to review the proposals and complete individual assessments. The Committee concluded that BAPCC demonstrated the best capacity to meet the overall objectives and selection criteria. Among their strong points are: 1) their financial ability to be a provider across all credits, lease terms and types of projects; 2) fulfillment of the City's minimum eligibility requirements; 3) identical cost of capital with it's competitor; 4) ease of administration, especially with respect to neither requiring a title lien or holding of titles on financed vehicles; and 5) their excellent track record of meeting the lease financing needs of the City. The Committee met to discuss the assessments and determined their final recommendation to the Director of Finance which was BAPCC's proposal. The Director concurred with the Committee's recommendation to move forward with an ordinance for introduction to the City Council officially accepting BAPCC's proposal.

Authoring the Court Administrator to execute limited term contracts in an amount not to exceed $383,087.00 for off-duty and reserve police officers to provide Municipal Court security with funds appropriated in the 2020-21 Annual Budget.

Megan Phannenstiel, Municipal Court, testified on this ordinance. Committee substitute for 200228 as Amended requires the City Council approve all limited term contracts. Currently, Municipal Court security is provided by off-duty and reserve police officers. This expense is budgeted in the recently passed 2020-21 Annual Budget and has been budgeted in the Municipal Court's budget in previous years. The Kansas City Municipal Court is one of the most heavily visited City buildings and the largest municipal court in the State of Missouri. The Court processes more than 250,000 cases per year; including a sizable number of domestic violence, child abuse and neglect, assault and weapons cases. The presence of sworn officers is needed to protect the safety and well-being of victims and witnesses, court staff,

Reducing an appropriation in the amount of $1,040,000.00 in the Capital Improvements Fund; appropriating that amount to the Convention Center Garage account; authorizing a $537,000.00 Owner’s Representative Services Amendment No. 2 to Contract No. 07-AR1902 with CBC Real Estate Group, LLC related to the programming, design and reconstruction of the Auditorium Plaza Garage and Barney Allis Plaza Event Space; authorizing contract amendments; approving the proposed program for the project; providing for a construction trades training program; declaring the intent of the City to reimburse itself from the bond proceeds for certain expenditures; and recognizing this ordinance as having an accelerated effective date.

Authorizing the Director of General Services to execute a three-year lease agreement with three (3) one-year options for renewal with Metro 24 Fitness LLC, dba Metro KC Fitness, for the purpose of fitness facility at 320 E. 12th Street Kansas City, Missouri 64106.

Ashley Wise and Yolanda McKenzie, testified on this ordinance. Metro 24 Fitness LLC, dba Metro KC Fitness, desires to lease the former fitness center in the Wolf Garage. The space consists of approximately 6,500 square feet and is located on the ground floor of 320 E. 12th St. Metro 24 Fitness will operate a fitness facility and other supporting services and would like to open for business starting April 1, 2020. Rent will commence on April 1, 2020 through May 31, 2023, for an initial term of 36 months, with three successive renewal terms of one year each, for a maximum term through May 31, 2026.
