Changes to the zoning text will not necessarily abate blighting conditions. A large number of these current uses may already be in violation of the provisions of the zoning ordinance and may only be abated through investigation and citation. Certain addresses will be provided to the Investigations Division as they become evident. The zoning ordinance is undergoing a major revision, to be completed by the end of 2006. For that reason, many other revisions necessary to bring these ordinances up to date will be deferred. Major revisions are as follows: 1) Regarding certificate of legal nonconformance, those uses that legally exist prior to the passage of these text amendments may continue, upon application for and receipt of a certificate of legal nonconforming use. Changes to Section 80-320 delete -- for text amendments to the zoning ordinance -- the requirement that the City publish notice of the Council action, identify nonconforming properties and uses, send notice to all property owners affected, and post the notice at two places on the property. Further, the requirement that affected property owners make application within one year of the  amendment to this chapter , or forever relinquish their right to request a certificate of legal nonconformance (CLN), will be deleted. These particular revisions involve only legal noncon-formances resulting from text amendments, not those resulting from zoning changes, such as those that occur with neighborhood downzonings. It is important for neighborhoods to retain that one year time limitation tool in order to require property own-ers either to obtain a CLN or to bring the property into compliance with zoning ordinance provisions. For those CLN s resulting from zoning changes, the < %s Gp L JtQ"  @Text 4>0nj]LtQ"9 u <notification requirements would be revised to ease the posting requirements. The 100,000 sq. ft. figure would not affect the smaller industrial user but would affect development encompassing roughly a full block. The special use permit and required development plan would be reviewed by the City Plan Commission and City Council. 3) Certain uses in District M1, per the current ordin-ance, are allowed if screened in varying ways, such as  entirely enclosed within a wall or cyclone type fence at least eight feet in height , or by a  fence . In the case of an auto body and fender shop, neither indoor storage or screening of an outdoor lot is re-quired. With the requirement for special use permit, all outdoor uses associated with auto body work, stor-age, waste management, etc. would require enclosure by a  masonry wall at least eight ft. in height . The wall would be a more effective and durable method of screening than would a cyclone type or wooden fence. Further, with the major revision to the zoning ordinance, staff will propose that all industrial uses, regardless of their size, be properly screened. 4) For all uses requiring separation or screening from an adjacent residential district, District URD (Urban Redevelopment District), if containing residential uses, was included. District URD is the zoning classification used for properties benefited by a financial incentive program and, as such, the City and developers have made significant investments in these properties.
