RESOLUTION NO. 031373
Approving an amendment to
the Beacon Hill/Longfellow Area Plan by modifying the Land Use Plan and Map for
the area generally bounded by Kansas City Terminal Tracks to the north,
Pershing Road on the south, Main Street on the east, and W. Pennway on the west
and from Pershing Road to the north, 26th Street to the south, Central Street
to the east and W. Pennway to the west to recommend public and semi-public and
mixed-use commercial/residential instead of retail commercial, office
commercial and mixed-use commercial and residential. (202-S-4)
WHEREAS, by
Resolution No. 46714 adopted July 15, 1976, the City adopted the Beacon
Hill/Longfellow Area Plan as a guide for development and redevelopment of that
area generally bounded by the Kansas City Terminal railway tracks on the north,
Troost Avenue on the east, 31st Street on the south and Southwest Trafficway on
the west; and
WHEREAS, said
Beacon Hill/Longfellow Area Plan was amended on January 11, 1996, through the
adoption of Resolution No. 951661, was again amended on August 14, 1997,
through the adoption of Resolution No. 970897, was amended on December 22,
1997, through the adoption of Resolution No. 971679, was amended on April 9,
1998, through the adoption of Resolution No. 980227, was amended on August 13,
1998, through the adoption of Resolution No. 980905, was amended on September
10, 1998, through the adoption of Resolution No. 980988, was amended on April
8, 1999, through the adoption of Resolution No. 990353, was amended on November
7, 2000, through the adoption of Resolution No. 001614; was amended on May 23,
2002, through the adoption of Resolution No. 020440, was amended on November
14, 2002, through the adoption of Resolution No. 021301; was amended on January
9, 2003 through the adoption of Resolution No. 021502; and was further amended
on November 20, 2003, through the adoption of Resolution No. 031194; and
WHEREAS, after
further review by the City Development Department it has been deemed
appropriate to amend the Beacon Hill/Longfellow Area Plan as it affects that
area of land generally bounded by Kansas City Terminal Tracks to the north,
Pershing Road on the south, Main Street on the east, and W. Pennway on the west
and from Pershing Road to the north, 26th Street to the south, Central Street
to the east and W. Pennway to the west to recommend public and semi-public and
mixed-use commercial/residential instead of retail commercial, office
commercial and mixed-use commercial and residential; and
WHEREAS, public
notice of a hearing before the City Plan Commission was published on March 3,
2003; and
WHEREAS, the City
Plan Commission considered such amendment to the Proposed Land Use Plan and Map
on March 18, 2003; and
WHEREAS, after
all interested persons were given an opportunity to present testimony, the City
Plan Commission did on March 18, 2003, recommend approval of the proposed
amendment to
the Beacon Hill/Longfellow
Area Plan; NOW, THEREFORE,
BE IT RESOLVED BY
THE COUNCIL OF KANSAS CITY:
Section A. That
the Thirteenth Amendment to the Beacon Hill/Longfellow Area Plan is hereby
approved as to the Proposed Land Use Plan and Map for that area of land
generally bounded by Kansas City Terminal Tracks to the north, Pershing Road on
the south, Main Street on the east, and W. Pennway on the west and from
Pershing Road to the north, 26th Street to the south, Central Street to the
east and W. Pennway to the west to recommend public and semi-public and
mixed-use commercial/residential instead of retail commercial, office
commercial and mixed-use commercial and residential. A copy of the amended
Land Use Plan and Map for the Beacon Hill/Longview Area Plan is attached hereto
as Exhibit "A" and made a part hereof.
Section B. That
the amendment to the Beacon Hill/Longfellow Area Plan is consistent and
complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by
Committee Substitute for Resolution No. 971268, and is adopted as a supplement
to the FOCUS Kansas City Plan.
Section C. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices have been given and hearings have
been held, as required by law.
